I think the general lack of accurate legal information is a problem on this forum, so I will attempt to clear up some misconceptions.
1) The National Rail Conditions of Carriage are contractual - and, for the most part, issues concerning them would be a civil matter.

Therefore private car parking company employees can be authorised to enforce the Railway Byelaws.
Whether they actually do go all the way to court - I'm unsure - but there is certainly nothing (legally) stopping them.
If it's from the central ticketing system then a couple of things strike me:
1) The number of tickets sold does not necessarily equate to number of passenger journeys.
2) Non recordable ticketed journeys, particularly in the PTE areas, will not be accounted for.
I don't think it's unreasonable to feel a bit impatient if you're stuck behind an unusually slow driver.

Anyone else fed up of those drivers going 20-30mph below the speed limit?
For the past 3 days, I've been driving on rural country roads where the national speed limit (60mph) applies - yet I've come stuck behind at least 10 drivers who are only doing 30-40mph on roads which are easily safe...
The Regulation of Railways Act 1889 still applies in Scotland. Whilst private prosecutions by the TOC, are incredibly difficult - the power of arrest for failing to pay and failing to provide name/address still applies.
I would be interested to know how many BTP prosecute for fare evasion.
That is just one of the several options available to the railway.
If a conductor is dealing with the matter, it is likely he will sell the most expensive single fare.
If an Inspector is dealing with the matter, it will be a day in court or Penalty Fare.
The customer obviously can't...
If there is a ticket office or self service machine, you MUST buy before you board.
The consequences (depending on area) could be:
1) Day in court
2) Penalty Fare
3) Full fare ticket being sold.
The reason I originally started this thread is that I actually own a sizeable number of Stagecoach shares as part of my investment portfolio.
This time last year, the price was above 410p/share, but ultimately has now reduced substantially down to about 250p/share, a near 40% loss in value...
Whilst reading the RMT website information on the Southern DOO row - I came across a link which basically implies VTEC is awash with serious financial difficulties.

The Off Peak Return 8A restriction (on this ticket) prevents Break of Journey on the outward leg, so you couldn't leave at an intermediate station and travel the second day.
You'd need the Anytime ticket with 5 days available for the outward leg.
(i.e. you need the £112.95 fare)
