I thought the same, though from the description of the incident I'd bet a pint on the young man in question having some sort of mental health issue. Of course, that's of little comfort to the guard and doesn't excuse the perpetrator's actions- it may explain them. Of course any details of such would rightly be unlikely to be released to the press, I'd hope that this young man will be given any help he might need to turn his life around. If he does have some form of mental illness, gaoling him would be unlikely to achieve such ends.

Courts will ask for psychiatric reports in all cases where they are appropriate before they pass a sentence. They may not be read out but the hearing will be made aware that such reports exist and have been read by the judges or magistrates and you can be sure that the defence solicitor would have mentioned any such issue relating to her client, if there had been one.

Surely the fact that a case like this is considered worthy of newspaper coverage is proof that tolerance to such criminal activity has gone down.

Dare I say that ten years ago even, such a story would not even have been considered newsworthy.

Oh, so you think the court reporter would have just sat there 10 years ago and thought, 'this one's not worth bothering with'? Grow up. The company that publishes the Shropshire Star has a long tradition of in-depth court coverage and that was the same 10, 20 or 30 years ago.

There is a degree of attempted ticketless travel between Newtown and Welshpool unfortunately and the better conductors are wise to it especially the Machynlleth based ones. We do get the odd train worked by Shrewsbury or Crewe conductors who are known to stay in the rear cab on an evening service. And dare I say they tend to be Male whereas the female conductors conduct the checks.

I've been a regular traveler on the Cambrian since 1979 and you can get upset as you like young man but the English based guards that work Cambrian services have over the years got a reputation for rear cab riding. This has got better in recent years presumably coinciding with Crewe conductors not working on the Cambrian anymore.

I was told by an old railway worker that London Midland railwaymen that Central Wales Division men encountered were known colloquially as "Jackos" a character who was always sloping about avoiding work with his hands in his pockets and fag in mouth.

The theory on conductors commission is that they'll be incentivised to do their job on collecting fares but there's still plenty of occasions when the conductors don't even walk through. As my friend Ted said the other week oh we're getting a free ride today.

You may view certain posts as absolutely sickening and you're fully entitled to your opinion.

Others may view certain posts as perfectly valid opinions, this is an internet forum which will contain opinions from all aspects.

But, having said that, I'm not sure we can rely on local newspapers to provide us with an accurate and full report. As has been mentioned there seems to have been no mention of the comments made by the judge when it came to sentencing. I also can't see any alternative to the advocate way of doing things. I agree with DarloRich that, under this system, everyone is entitled to a defence and mitigation, but I would be interested to see any proposals for a different way of doing things.

Finally, DownSouth's description of the structure of the legal profession and the phrasing of mitigation into a code, is pretty accurate according to previous discussions with some legal friends of mine, one of whom is a retired solicitor.

Exactly - that is what I meant by a simplistic view point on the criminal justice system.

I am all for locking people up (trust me my views on crime & prison are VERY right wing!) but sadly whilst we all seem to want people locked up, and as a society locking we are locking more and more people away, the prisons are bursting. We want more criminals locked away but we don’t want prisons built near us nor do we want to pay for them.

Community punishments have a place in the system. The very clearly serve the need of justice being seen to be done. That said they need to be more visible and more “shaming” for the criminal. The flip side is that it is easier and cheaper to lock a bunch of criminals up in a church hall and have them paint it under the supervision of 1 or 2 officers rather than have them out and about in the community under the supervision of several officers.

My personal view is that the little scroat should be locked away for a period in a hash environment, especially as he seems to have history, perhaps involving some “forced” labour as part of a community punishment. Sadly, neither the sentencing guidelines nor the prisons policy don’t allow for that.

A couple of bits of info.

Guard L Caisley is back at work and has worked 1G07 0514 ex Aberystwyth this week.

Crewe drivers and guards used to sign the Cambrian but not any longer. It is at least four years since any ATW Crewe traincrew worked over this route.

A couple of Pwllheli traincrew have signed east of Machynlleth. One driver (an ex Mach driver)and one guard (who has always been at Pwllheli) but they no longer sign this route but there is talk of all Pwllheli traincrew signing to Salop next year.
