The americans don't have access to our database, only the international one for serious offences. Even if they did check you out simple arrests wouldn't show up, neither would non-serious convictions.
They would have to be given suitable advice, otherwise it would be grounds for a mistrial!

If they suspected fare evasion then they could issue an MG11. I don't think it would be valid to tell the person that they can either buy a single or get an MG11, as the NRCoC states that the person would be entitled to a return.
This! I was getting a train from Bristol to Paddington, and I'd finished an hour early. When the train before the one I was reserved on arrived, I found the guard and asked nicely if I could get on that train (explaining that I'd be happy to wait if I needed to). The guard was perfectly willing...
Surely if they hold a ticket from the previous stop on the ECML to the first station in the validity of the ranger (even though the train doesn't stop there) it'd be valid under the NRCoC

One thing that could be done is, rather than PFing people who get on trains with platform tickets, that the TOC could prosecute for fare evasion, in that case, it's clear that they were deliberately evading the fare and so it would mean the TOCs could get more money.
only difference being, he does have a valid argument (no opportunity to buy said ticket at the station he boarded at as they don't offer it) AND he had confirmation from the managers that he was right!
