Where there are persuasive grounds to believe that a Criminal Offence has been committed, and there is adequate Evidence to support a Prosecution, then it is likely to be in the public interest to Prosecute (it may also be in the interest of the Railway Company who have incurred losses).

Any written suggestion that an out-of-court settlement might be accepted as an alternative disposal will have no bearing, particularly where (as in this case) the settlement was not made.

The TOC decide what to charge you with first and then you can plead guilty.

If the OP has simply evaded his fare and NR are offering an out of court settlement, then he should jump at the chance

If the OP has knowingly given false details then surely he forgoes his "chance" and a prosecution is in order.... or could he still have got a letter with an offer to settle out of court?

If you have been reading the thread Robert 711a, the OP was sent a letter indicating a court date and settlement but Northern when contacted have confirmed that they are in fact not offering a settlement.

He is not able to jump at the chance as it has been taken away

But post #23 indicates some uncertainty. In any case, it's either settle out of court or a guilty plea.

However, it appears that the TOC never intended for that offer to be made, and it may well no longer be an available option. Agree totally that it should be grasped with both hands if still on the table.

Perhaps the OP should send in a cheque in response to the settlement offer, and see if the company banks it.
