Where there are persuasive grounds to believe that a Criminal Offence has been committed, and there is adequate Evidence to support a Prosecution, then it is likely to be in the public interest to Prosecute (it may also be in the interest of the Railway Company who have incurred losses).
Any written suggestion that an out-of-court settlement might be accepted as an alternative disposal will have no bearing, particularly where (as in this case) the settlement was not made.
