How long is it after passing out before a post qual driver can apply for other TOCS? I was sure it was 2 years but have just read a job description and it doesn't specify a timescale at all.

There isn't a time, a PQ driver has a lesser chance of getting a position than a driver that is not PQ, you need to read you contract on times as some companies will say you have to pay back the training costs if you leave within a certain time period.
Which is not enforceable by law
It isn't but will look crap on your reference when you decide to leave.
I think that currently most employers would refrain or refuse giving references rather than give a negative one. By giving a negative one you're opening a new can of worms ...
You should laugh all you can, it's healthy after all.
That doesn't change the fact that around half of references requests I receive back are standard letters that say pretty much: we can confirm that named person have worked for our company but because of our policies we will not give you any more details about their employment record.
Also the company I work for has a policy to that effect and believe me that it isn't in place because we can't be arsed to get them properly done or because of them all being negative.
Most TOCS want three years or class that as becoming post qualified
