How is the situation different from buying an off-peak ticket, and travelling at peak time? And so there is this concept of having your cake in buying a railcard discounted ticket for a time it isn't valid due to an additional restriction (as well as being not valid due to being an off-peak ticket rather than an anytime) and the only punishment if you are caught out by barrier staff who are paying attention is simply paying what you should have paid originally?
So similarly, I presume if you are in Tesco buying loose veg and 'accidentally' select a cheaper veg at a self-service checkout, you simply have to pay the difference if caught out?
The same situation of the only punishment being that you pay what you should have paid in the first place applies.
