Misuse of student oystercard

this is what I replied to them:

I am writing regarding the incident on X date and would like to offer my sincere apology.

I sincerely apologise for using a Student Oyster card that was not issued to me. I fully understand that concessionary Oyster cards are issued for the use of the named holder only and that using it was wrong. I regret my actions and take full responsibility for this mistake.

When I was stopped by the inspector, I was extremely nervous and did not explain the situation clearly. I would like to correct this now and be fully honest. I acknowledge that I have used this card on previous occasions over a period of time, and I deeply regret both my actions and my lack of clarity at the time.

Although this does not excuse my behaviour, it has been a very difficult period personally. I have been supporting my father following treatment for metastatic cancer while also working full-time and self-funding my CIPD Master’s studies. During this time, I have also been the main person supporting my family financially and managing significant personal and financial pressures. Despite trying to manage these responsibilities, I made a poor decision in using this card and I fully accept that it was wrong. This experience has been a serious wake-up call for me and I deeply regret the poor judgement I showed.

As someone currently studying for a CIPD Master’s qualification and pursuing a career in Human Resources and employment law, I am very aware that a conviction could have a serious impact on my professional future. I have always maintained a clean record and have never previously been reported for any travel irregularity.

For context I have enclosed a copy of my father’s recent oncology review letter confirming his ongoing monitoring, together with confirmation of my Master’s enrolment.

I understand that your investigation may review the previous use of the card and I accept full responsibility. I am willing to repay the full value of any unpaid fares identified through your records together with any administrative costs. I will accept the amount calculated by TfL and would be prepared to settle this promptly in a single lump-sum payment.

Since the incident I have arranged my own valid travel payment method and have been paying the full adult fare for my journeys (a copy of my recent travel history is enclosed). I will ensure that I always travel using my own valid ticket in the future.

I respectfully ask whether this matter could be resolved without court proceedings. I would be extremely grateful for the opportunity to make amends and move forward having learned a significant lesson from this mistake. I will cooperate fully with any further information you may require.

I wanted to reply ASAP - I'm terrified of this process, I didn't think even for a second this could lead to a legal matter. This was a serios wake up call for me. Shall I share here my response?

This is the letter. On the back I've replied with this

I acknowledge that I committed an offence by using a Student Oyster card that was not issued to me and I sincerely apologise for my actions. The card was confiscated by the inspector at the time of the incident. Please see attached written explanation and supporting documents for full details of my response.

Why are you asking for a settlement? TfL never settle out of court. You will either receive a final warning, or it will go to court. You will not be given the option to pay a settlement. The verification letter is an opportunity for you to put forward any options to
Mitigate. I do t feel anything you have put in your letter is going to get a final warning. At this stage,
It may be in your interest to contact directly one of the specialist train fare specialists who may be able to resolve this for you
I’m thinking manak sols, or ther are a couple of others who are able to put the argument better, but at a decent charge, iro £600 to £1000.

Otherwise I would expect you to receive a court summons very shortly.

Again, I asked about a settlement because I thought it might be a possibility – perhaps incorrectly – as I have never been in a situation like this before. I genuinely appreciate the information you’ve shared and understand you have more experience with these cases. Forum members will be happy to assist you, and while your individual case is unique to you, we have seen many similar cases over the years and tend to know what the outcome is likely be. To be able to give appropriate advice it is very important that you tell us what happened and share any paperwork received (but do redact any personal details before uploading).

When it comes to responding to letters it's best to allow forum members to proof read them. Understandably many people want to reply promptly but it's important that any replies are clear, concise and don't inadvertently make things worse.

TfL take misuse of Zip Oyster/Student/Freedom Passes (and other 'high value' passes) very seriously and they almost always prosecute. They do not offer out of court settlements but there is nothing wrong in asking for one. When looking for reasons to persuade them from prosecuting then I suggest reading TfL's Revenue Enforcement and Prosecutions Policy, specifically section 8.

Thanks for the info. As mentioned above, I've already replied before posting here - was just anxious in wanting to resolve this ASAP. I'm really sad and worried after readin all the different posts that 99% I'll end up in court which most likely will affect my future CIPD career. I just wish there was something else I could do to avoid this ( which I know each person would like this for their own case).

Sorry to be blunt but TFL will prosecute you and you will be convicted.
They want to demonstrate to you and other people that this kind of Oyster card misuse is unacceptable.

That was a very unwise thing to write as you have given TfL an admission of previous offences.

That will almost certainly now involve you being summonsed in person to attend court to admit those other offences being taken into account when your being sentenced so that will add to the compensation amount you will be required to pay

They would probably have asked anyway and the op is remorseful so might well have admitted it.

Did TfL take the pass off you? Is it your part need pass? Have they received any communication from TfL?

I assume there is the issue that if he was allowing you to use it thus may cause problems for him too. I’m not sure what happens in this scenario but others may be able to advise.

You might not wish to engage in that aspect of things if asked about by TfL.

The card has been confiscated by the inspector on the day. My partner hasn’t received anything. I told the inspector he didn’t know I was using it I said I took it from the table as we live together.

I decided to confess because I don’t want anything else to backfire on me, they’ll most probably analyse the travel/commute pattern and will see the same routes.

So it may be that he can apply for a replacement card.
Logic suggests he should maintain a consistent story about the card.
