Is there any kind of legal definition or accepted meaning for what constitutes first class? If a TOC decided to mark a standard class carriage as "first class", charge more, but change *nothing* about the interior, would that be legally defensible? Given the very different offerings in first class, from Virgin's EC with nice seats and free drinks and snacks, to the Gatwick Express's first class "antimacassars only" offering, I'm guessing the answer is no, but I'd like to hear the forum's comments.
