I suppose the first question is - do you mean the locomotive (is there an electric loco called it too?) or the express service between London and Edinburgh.

I mean the Royal Scot Steam loco and I mean copyrighted in part.

Not sure what your question is exactly but the locomotive is owned by The Royal Scot Locomotive and General Trust (Registered Charity No 1139588). Their website is http://www.royalscot.org.uk/. So perhaps your question is best directed at them, as the owners.

There is also the use of the words in connection with the former army regiment, the First of Line, to be considered. Although not specifically copyrighted, there may be restrictions in law regarding the use of regimental names.

The last train service called Royal Scot ran in 2003 under Virgin Trains.
Like other named WCML express trains I expect the rights to the name as a rail service lie with the West Coast franchise, or with the DfT (and in future GBR).
The service always ran Euston-Glasgow Central, with a portion for Edinburgh Princes St during some periods.

Bear in mind that if we are talking about use in regards to making models or simulations you may be able to argue that your use of the name is necessary to create an accurate replica.

If you are thinking about the actual loco, Royal Scot, then it is design patents that are relevant if you want to make a copy (full size, or model). As the design is over 80 years old, any patents will be long-expired.
