Does it say anything more than "the correct ticket", e.g. claiming that Southern or Thameslink only tickets aren't valid?

Its made at every station on the GTR network south of the river usually in connection with cancelations or delays.

The correct ticket is any ticket valid for travel between those stations at that time, regardless of any purported brand restrictions.

If you are charged an excess, new or penalty fare, please pay it (you can do so under duress); preferably by credit card and write to the company asking for a refund. I am happy to help with proof reading of any such letters. I'm also happy to ensure that any forum members in this position are not left out of pocket.

I'm not aware of anyone who has been charged by GTR (or indeed Southern in the pre-GTR era circa 2008-15) who sought advice here, and did not get their money back.

If GTR are giving refunds to anyone who has these types of tickets, why are they defending themselves in court? Surely the very fact that they pay up every time someone complains is an admission they’re in the wrong…

Indeed. Lots of services all around the country make similar announcements (both automated & manual).

I suspect the proportion of people who seek refunds is tiny.

Also bear in mind that many tourists and other passengers simply pay the overinflated fares!

How many people pay the lower price and travel on the "wrong brand" and are actually challenged and charged and go on to complain, compared to those who are simply overcharged? It could be a ratio of something like one to several hundred.

Make no mistake, premium pricing is a nice earner for GTR/DfT, but it's more about people paying over the odds up front, than actually being charged an excess/additional/penalty fare.

Indeed, the automatic announcements go something like 'I'm sorry to announce that the 0730 train to x is cancelled. Passengers for x, y and z, the next fastest service will be the 0728 to b. Please make sure you have the right ticket for this train.'

Nothing at all to do with GTR / GX tricks, just inviting passengers to consider whether they have the right ticket to catch an alternative service.

Even without GTR / GX tricks, there could still be someone at Victoria who doesn't have the right ticket to travel on an alternative service.

I still have doubt about using a ticket for the "wrong brand" on a Gatwick Express train as it won't pass the "man on the bus" test in court if challenged - the only argument here is GTR doesn't have power to brand-restrict the tickets in the NRCoT.

However, some Thameslink-set Any Permitted fares on flows to north London with a cross undercut the Gatwick Express fare anyway so I have no need to get myself into that legal minefield while still paying the cheaper fare if travelling on the Gatwick Express.

Really? "Sorry sir, your Thameslink ticket isn't valid; I will charge you a penalty fare. Here is your form, issued by Thameslink and here is your bank receipt from Thameslink "
- the only argument here is GTR doesn't have power to brand-restrict the tickets in the NRCoT.
That's a major problem by itself and it's far from the only one!

Yes there is a huge premium for Gatwick to London Victoria; it's absolutely clear that it is Gatwick to Victoria which is overpriced, and not the other way around!

I just want to be clear that the announcement I heard was not in a relationship a delay or cancellation. It was a standard train announcement and we all know what GTR mean, or what Gatwick Express mean, in this case mean when they say to make sure your ticket is valid.

On the CIS screens at, Brighton, Preston Park, Hassocks, Burgess Hill, Wivelsfield, Haywards Heath, Gatwick Airport, London Victoria, there is always a message displayed saying "tickets marked NOT GATWICK EXPRESS or SOUTHERN ONLY or THAMESLINK ONLY are not valid on this service" whenever a Gatwick Express service is displayed.

They should not be selling or enforcing brand name restricted tickets but yet they continue to do so. I am surprised that GTR have managed to get away with this for so long. So many confused tourists are made to purchase a brand new full price ticket when they turn up at London Victoria with a ticket that the staff do not think is valid. I thought i heard something about a legal case going on against GTR regarding this but i have not heard any updates on this for a while so i am not sure what is going on now.

Quick question - if the brand restricted fares are withdrawn, would this mean that only the any permitted fare would exist?

This would be a bit more expensive then some if the Thameslink only tickets. I don't really see there going to be a GTR only fare between London and Brighton for example, as GTR are the only sensible route for that journey.

That is no doubt the sort of argument that GTR will be making in their defence against the class action claim.

But the evidence suggests they are wrong; on flows with (purportedly) brand restricted fares, the Any Permitted fares are clearly overpriced in comparison to the 'normal' fare.

For instance, an Any Permitted Anytime Day Return from Brighton to London Terminals (set by the Southern brand of GTR, with the intention of it being the "Gatwick Express" fare) is considerably more expensive than one from Brighton to West Hampstead Thameslink (set by the Thameslink brand of GTR).

And the latter fare is valid on the Gatwick Express from Brighton to London Victoria on the Gatwick Express anyway since it is routed any permitted with a +.

Interesting; perhaps someone could get a photo of this.

People who insist refunds are refunded so until the collective competition claim came along, there wasn't any legal challenge.

The Any Permitted fares are clearly overpriced, especially for London to Gatwick but this is also true of London to Brighton. Any Permitted fares from Brighton to North London destinations can be cheaper than just to London! Also there is no reason why the Not Underground fares cannot continue to exist and these are no more expensive than Thameslink Only.

There doesn't seem anything in principle wrong with the idea of brand specific fares. So why doesn't DaFT just fix this by changing the NRCoT? It has made changes far more detrimental to passengers than a change affecting one line, e.g. the "timetable of the day" thing.

In theory they are no different to the introduction of TOC specific fares, yes.

However, the usual example of e.g. WMT only fares on the WCML (where these offer a discount in exchange for a slower journey, and thus represent a form of product differentiation) is in no way applicable here.

Any Permitted fares on the Brighton Main Line (originally priced by GX) were hiked in conjunction with the introduction of the GX 'tax'; this is demonstrated by the fact that Any Permitted fares for longer journeys (which were priced by other operators such as TL) are cheaper in several instances!

It is also highly wasteful of capacity to have trains running non-stop through busy interchanges such as Clapham Junction and East Croydon - and then charge more for them, with the effect that they end up half-empty. A rational utilisation of capacity would encourage people travelling to Gatwick to use them!

Whilst the DfT might ultimately make such a change, that wouldn't retrospectively regularise their and GTR's actions.

That is much less of an issue now. The Southern and Thameslink services also now run with spare seats and the Gatwick Express services carry more people from Brighton and any other stations they stop at. Gatwick Express is nowhere near as wasteful as when it ran 4tph Victoria to Gatwick and the capacity issue has essentially gone away.

Disgusting!

I was recently on board a Southern service where the OBS announced that Thameslink Only tickets are not valid. This was being operated using GX stock.

I was also recently on board "Southern service operated by Gatwick Express" according to the OBS announcement.

The misinformation GTR are giving out is disgusting!

And this is what it used to say in 2012 (image - taken at Brighton - at bottom of post #38 linked to here). These services were marketed as Southern. But I think they were GatEx extensions from memory.

How do GTR claim they're getting around the rule where the TOC setting the any permitted fare can't also set an operator-specific fare? because that also seems to be a problem

Thameslink only fares could of course be resolved by setting them as via X, where X is an appropriate station to prevent travel to/from london victoria, maybe london bridge?

I'm sure GTR wanted this situation gone away as much as everyone else. The differential fares were all meant to be withdrawn as part of the TSGN implementation under the franchise change but it became politically unacceptable for the DfT to authorise it because of the London Bridge issues shortly after the franchise was put together.

The 'London Thameslink' destination deals with tickets not being valid to Victoria. 'Via Forest Hill / Streatham' isn't ideal as a restriction.

Out of curiosity, what london bridge issues are you referring to? a quick google search only seems to lead to articles about the state of (dis)repair of bridges in london

I suspect the OP is referring to tickets issued to cluster Q060 (that contains Kentish Town, West Hampstead etc) which aren't issued with Not Underground restrictions.

At the start of 2015, which is when the through Thameslink route was diverted away from London Bridge there was significant disruption to services into London Bridge. Subsequently there were issues with the initial Thameslink operation due to staff training.

London Bridge Chaos Continues For Commuters

Sorry seems to be the hardest word.

Things haven't got much better for commuters using London Bridge station, with further reports of overcrowding, cancelled services and lack of information.

In January, we wrote about how work being done at the station for the £6.5bn Thameslink programme has led to severe delays for passengers, who branded the service 'a disgrace'. We've since seen some alarming pictures of passengers having to jump ticket barriers to avoid being crushed on the concourse. One passenger told Londonist that, "at least 50% of my Southern trains into London Bridge in the morning are either delayed by at least 10 minutes or cancelled".

Attempts to prevent overcrowding on the platforms don't sound much better — we've been told that once a platform is announced, around 50-75 passengers are let through while the rest are held behind a barrier until a couple of minutes before the train leaves. At that point, the barriers are opened and "a crazy stampede" ensues.

Network Rail introduced a series of measures to try and solve some of the congestion problems, including extra station staff and better information for passengers. It didn't go quite as planned — evening rush hour signal failures on Tuesday knocked out two of the station's four lines, causing even more delays. Phil Hufton, Network Rail’s managing director of network operations, said in a statement:

“In the last few weeks passengers have experienced unacceptable levels of service and over-crowding at London Bridge station. Passengers have been very tolerant about the changes to their usual travel arrangements, but understandably they have lost their patience with the recent poor service experienced for which we are very sorry.

“I want to assure customers that we do take this situation seriously and Network Rail is committed to improving our performance by delivering improvements to deliver a safe environment for users of London Bridge hand in hand with meeting the level of train provision and customer service they rightly expect.”

If things had gone smoother, the plan was to increase all of the operator restricted fares more quickly than the any permitted fares to eventually remove them.

The Any Permitted fares on many flows would have to reduce if there was going to be any form of harmonisation; there is no getting away from the fact that Gatwick to London in particular is incredibly overpriced.

Let's not forget that all engineering works posters list all the company brands but don't list any other companies whose trains might also run on the lines.
