I doubt it, as if you feel wronged you can always try your luck in the magistrates' court.

Hopefully I won't ever be in this position. But,I would be tempted to send them the outstanding fare and leave it there just to see what they would do.

From a trawl round the net there doesn't seem to be any legal backing for the fixed penalty. They seem to rely on threatening people with fines of "up to £1,000" if convicted when we all know fines are set by magistrates and many factors come into play, including the ability to pay.

Don't misunderstand me. I think people who deliberately evade the proper fare for their journey deserve all they get. And I know that many of you involved with this on a daily basis will say, with some justification, that its difficult to differentiate between those who are working the system and those who have made a mistake or misunderstood how things work.

But there are far too many cases where everything is not all cut and dried.
