That was outcome number 2 on my list of probables! I predicted they'd both be in Court tbh. Can't help but feel that the powers that be have bottled out, rather than cause a large-scale version of the previous debate on here!

I am glad to see that the Fiscal has decided not to proceed with this matter.

While I am reluctant to see an alleged fare dodger "get off" so easily, given the circumstances of the case I feel that the decision is the right one. I am also pleased that the Fiscal has been willing to stand up and take the publicity hit on this rather that take the easy way out and let the cases time out quietly.

Arguably Main had his (justly deserved) punishment a couple of months ago.

As for Sam Main, it's a shame that he won't be prosecuted, but I guess that you could say justice has been done as he is unemployable, and at the end of the day he did not get his way!

They either both had to be punished, or neither IMO, and seeing as Main got a punishment to start with, as well as becoming an internet villain, I think it's a happy result all round.

Personally, I doubt it.

Sam Main won't have heard the last of this affair. I'm sure due to peoples memories and the internet this will come back to haunt him in the future, that in itself will probably prove worse than any punishment a court would have handed down.

It was a fairly clear case of Common Assault to me... I'm glad that it didn't get to court though, rightly imo, as it wasn't in the public interest.

Happy that the Big Man hasnt been charged, as for the Scrote Main, well Im afraid for him this is gonna haunt him for a long long time to come, the passengers will no doubt hate him and as for Scotrail, he is gonna be watched like a hawk by their revenue protection team!!!!! Not under Scots law; if Pollock was acting in self-defence of another, and if he had no intent to injure, it would not be classed as an assault.

Common sense has Prevailed now how do we go about ensuring the Big Man is given a reward for his actions

Glad to see that the Big Man didn't get prosecuted. Main received his punishment when he was thrown off the train - a bit of hands on justice will teach him a lot more than a couple of weeks in a soft prison.

Main of course will continue to be punished for this going forward. His name will be mud with potential employers, so he will probably find it harder than he would have to get a job - no company will want to be associated with an Internet fare dodger who was physicaly thrown from a train and the majority of the public sided with the Big Man.
