From what I understand you can ask your previous TOC for the money but they are under no obligation to pay it to you.If a deal can finally be achieved but you have left the toc you were at in 2022 and now work at a different toc would you still be entitled to the deal/payout. I'm reading and hearing conflicting scenarios.

I asked the question of our HR on behalf of someone leaving the business and they said you would be entitled to the back pay, but it wouldn't automatically be paid, you would have to ask for it.There are a few drivers at my TOC who want early retirement but have been hanging on for the back pay when a deal is agreed. Some have now been told not to worry as it will be paid in full & forwarded when it eventually happens if they do decide to bail out now.

I am not sure about ASLEf, but I have asked RMT and this is what they have told me:
Once you have left your current company, you would no longer be entitled to any back pay.
If someone were to leave their role for another grade which is represented by the RMT, they would receive backpay at the rate of their previous role. If they were to leave their role for one which is outside of our collective bargaining agreement (TSSA are usually responsible for management grades) then they would not be entitled to RMT-negotiated back pay.
As a train driver you would still be welcome to remain a member of the RMT on an individual basis, as we are an all-grades union.

Indeed. If it's signed off with the bargaining unit, everyone still in a contract if service will get it. The right to it is through their contract, not through membership of the trade union.The company doesn't even know who is in what union so would have to pay it to everyone. Just because a pay award is negotiated with the RMT, doesn't mean it is for RMT members only.

To be fair there are other details and ways people could have left , through a settlement agreement , via dismissal , they may have left giving short notice or owing the company AL . Some of these may impact entitlements .I got a reply off RMT yesterday that I'd have to apply (in my case to northern trains) but it would depend on the circumstances of me leaving my current job. I handed my notice in and it was accepted. What more is there to it?

My contract states 3 months but my manager said if there is a start date from my new toc they d try to release me before and so I gave them 2 months. I am still employed by northern for another month but all my emails received have been to tell me what to bring for my exit interview and to wish me well in my new role. I suspect the emails are not just answered by one individual either so would recieve a varied response .
