2022 pay deal

If a deal can finally be achieved but you have left the toc you were at in 2022 and now work at a different toc would you still be entitled to the deal/payout. I'm reading and hearing conflicting scenarios.

From what I understand you can ask your previous TOC for the money but they are under no obligation to pay it to you.

I’m in a kinda similar situation. Still at same TOC but moved from train manager to driver in April. I should be owed back pay from previous grade shouldn’t I?

There are a few drivers at my TOC who want early retirement but have been hanging on for the back pay when a deal is agreed. Some have now been told not to worry as it will be paid in full & forwarded when it eventually happens if they do decide to bail out now.

So I am in the same situation. I am not sure about ASLEf, but I have asked RMT and this is what they have told me:


Once you have left your current company, you would no longer be entitled to any back pay.



If someone were to leave their role for another grade which is represented by the RMT, they would receive backpay at the rate of their previous role. If they were to leave their role for one which is outside of our collective bargaining agreement (TSSA are usually responsible for management grades) then they would not be entitled to RMT-negotiated back pay.



As a train driver you would still be welcome to remain a member of the RMT on an individual basis, as we are an all-grades union.

I'm with the rmt and would still be in the same union once I transfer.
I did email my local rep but never got a reply so you ve done well there. Can I ask who in the tmt you received that information from please.

It was from the RMT helpline. That’s their email: info@rmt.org.uk

They replied within the same day.

I asked the question of our HR on behalf of someone leaving the business and they said you would be entitled to the back pay, but it wouldn't automatically be paid, you would have to ask for it.

That makes sense but our LDC ASLEF reps are chasing things up on behalf of those affected I think.

Don’t know if you could help with this. If I leave the RMT now and join Aslef (which would be a logical step as there are no RMT driver reps at my depot) would that mean I forfeit any back pay from the 2022 award?

The RMT are deliberately scaremongering to try and keep people in their union. If you are still working for the same company you will get the backpay, regardless of whether you are in the RMT, ASLEF, or neither, The company doesn't even know who is in what union so would have to pay it to everyone. Just because a pay award is negotiated with the RMT, doesn't mean it is for RMT members only.

I'm fairly sure there's nothing to say you're not entitled to pay membership in both should you wish to take that option up? RMT do have driver members, albeit few.

I don't know if it'd make any difference though because really you're relying on you having a contractual relationship with the same company. What the RMT's email likely means is that they can only raise the issue directly with the company from a member of staff in a represented grade, rather than a member of the union. Either way the only honourable policy is the one as confirmed by @TEW's company above, namely if a pay award is finalised the back pay will be agreed on request.

Indeed. If it's signed off with the bargaining unit, everyone still in a contract if service will get it. The right to it is through their contract, not through membership of the trade union.

There are drivers that hold both memberships.

I was a signaller and now I’m a driver. I was told that I’d be entitled to back pay but it would take months.
RMT told me that they’re not obliged to contact you for payment. If you want it, then you have to contact them.

Why are they telling some that they are entitled and others it depends...

To be fair there are other details and ways people could have left , through a settlement agreement , via dismissal , they may have left giving short notice or owing the company AL . Some of these may impact entitlements .

I suspect the emails are not just answered by one individual either so would recieve a varied response .

No it shouldn’t.

But someone could have been, for example, summarily dismissed which would probably be a much bigger issue.

Yeah of course. Just wish something would get sorted we ve been waiting ages now. I believe the RMT is now discussing a rest day work ban. We certainly need to be more aggressive that's for sure.
