Just my thought, but I bet the people reading these see the word 'accidentally' all the time and will just glaze over. If you used phrasing like 'unwillingly overtravelled' or even 'was made to overtravel' then it might mark your letter out as something different and make them actually read it ?
When you say that you can attach proof if required, proof of what ?
What grounds do you want to appeal it on ? Is your contention that you haven't done anything wrong, or is it that you just don't want to pay out that much money ?
Same here. On my honeymoon, 28 years ago, we'd taken a day trip from Frankfurt to Heidelberg. Because the train back was an ICE, Germany's not particularly high speed train, we had to pay a fairly hefty penalty even though, as far as I was concerned, I was just using my return ticket to get...
Obviously you shouldn't lie when responding, but it isn't really so far fetched that, if the two stations are pretty close together, that a healthy young student wouldn't walk to the other one to save a fiver. They would be very unlikely to have any proof to the contrary.
How does the court find out who the employer is if you don't tell them ? How much investigation will they put into it ?
Also, as the employer, does the court not write to you first to check whether they do actually work for you ?
Just my opinion, but if:
a) You are confident that you have done nothing wrong, and that your situation just 'looks bad' AND if you can deal with the consequences of things not going your way in court AND have the time to devote to it then by all means fight it
or:
b) You have done something...
To be fair, the OP hasn't said it in so many words but I think, reading between the lines, there has been some (in their opinion) minor bending of the fare rules going on in at least some of the cases. I'd just leave well alone after paying it off. Though they may be feeling hard done by, I...
Personally speaking, I think you should just pay up now. You've managed to reduce it from the original 1100 quid, so this hasn't all been in vain. This will settle it, and the worry about other TOCs coming after you is almost certainly unfounded. Going into bat on this and GDPR points...
I'm pretty sure it will just count as a mistyping, rather than fraudulent. It doesn't seem to affect the amount you owe, assuming it was bought after you began your 20/4 journey.
I'll have to start of by saying that your story and subsequent explanations all look fishy to me, and will look fishy to them. But, the very nature of unusual situations is that they are very unusual so, if you are going to keep rowing forward with this, you will have to make the evidence...
Just to double-check, when you say your daughter hadn't downloaded her railcard to her phone - Is that the case, or is it that she had bought it but hadn't activated it yet ? It might sound like the same thing but would make a difference
Sadly, he just said that so that you'd think he was a pretty nice dude and he made giving you the bad news into someone else's problem.
(Having said that, it doesn't hurt to try, maybe even have a bit of fun with the wording in the hope you make someone smile, but it almost certainly won't work)
No-one can absolutely guarantee that there won't be any issues, but there is a lot of collective experience that can tell you that there almost certainly won't be.
If 'your friend' wants to absolutely put it to bed and nothing is going to put his mind at rest, then he should write in, confess...
Are you sure that you are actually in trouble for what you think you are ? I'm not sure how legally binding your 'name used' is over here anyway.
First question - Are you actually aged 16-25 and eligible for a railcard ?
Second question - How did the name thing come to light ? If you were...
I had a query on here the other week, with regards to Contactless fares between Reading and Gatwick. Basically, the National Rail website was giving the wrong information and various forum members were able to identify why it was giving that wrong information.
The 'online help' from various...
To be fair, in the OP they do state that their Railcard expired in March 2025, so that would lead you to expect that they held one for, at least, some of the March 2024 to September 2025 period.
