    Interview under caution question

Interesting, you are entirely correct, I eat my words. The wording seems quite black and white, if the person produces a ticket ‘showing that his fare is paid’ then the power of detention is not available. There doesn’t appear to be the benefit of being able to use mere suspicion, as constables...

    Interview under caution question

Only by a constable, surely? There’s no specific power of arrest or detention in the Byelaws to my knowledge. The ‘any person’ power of arrest (S.24A PACE) can’t be used for summary-only offences. Therefore, the only power I could think that would exist is the constables’ general arrest power...

    Interview under caution question

Nine times out of ten the suspect has little clue about where they actually stand legally. Solicitors often get given a lot more information about the available evidence prior to interview. They will have a better knowledge of the offences in question and the points to prove. They have a...

    Interview under caution question

You can indeed, but the whole purpose of an interview is evidence gathering. I’d suggest that if they have the evidence to prosecute you regardless of what you say then the interview is still of no real use. Nine times out of ten, being interviewed without first seeking legal advice is likely...

    Interview under caution question

It’s up to them if they allow you to re-attend or not, but I for one would not attend an interview without legal advice. There is no benefit to the suspect to be interviewed without legal advice. The courts cannot draw the inferences from questioning if the suspect is not questioned.

    Interview under caution question

Lol, that’s a fair point. Under those circumstances I would explain that you wish to speak to a solicitor prior to the interview and arrange a date to re-attend. Refuse to be interviewed until you have sought legal advice.

    Interview under caution question

My advice would be to speak to a criminal law solicitor prior to attending an interview under caution.

    Interview under caution question

Basically there is three parts to the caution: “You do not have to say anything” This is self-explanatory, you have a right to silence. “But it may harm your defence if you do not mention when questioned something you later rely on in court” This is the tricky bit. Basically, a court can’t...

EMT Trainee Driver Vacancies - Northants

Afraid not, I’d give recruitment a bell. Maybe that date has filled up?

    Tfl oyster card 16+

Just beware, your actions could amount to fraud by false representation (Fraud Act 2006), which is indictable and therefore not subject to a six month limitation period. I think it unlikely that they would resort to that charge though, as the Byelaws probably have a more appropriate charge.

Applying for Train Driver roles overseas

Yeah, I can’t see a TOC sponsoring you unfortunately, but it’s worth a phone call or an email I suppose. If you were an EU citizen it wouldn’t be an issue due to the freedom of movement within the EU. Maybe Donald and our future PM will negotiate something similar once the Brexit mess is...

Interview Under Caution with vulnerable adult

Failing to follow PACE codes does not make the interview inadmissible in itself. Rather, it would give cause for the interview to be excluded under s.78 PACE if the court rule that the evidence was obtained unfairly (which is the point of the codes). I would suggest that a court would be likely...

EMT Trainee Driver Vacancies - Northants

Just had my invite for Stage 1. The email says: “...Please note we are currently checking all candidates testing records with The OPC to see if you have sat the tests before and if they are valid for us. ***Please note if you are not required to resit the tests we will let you know next week...

EMT Trainee Driver Vacancies - Northants

I got the shortlisted email, but have never done an assessment centre for a TOC, so i think they just send that to those that pass the paper sift.

EMT Trainee Driver Vacancies - Northants

I’ve thrown my hat in. I currently work in Kettering so it would be ideal. I had previously been offered a place on an assessment centre with EMT for Derby Trainee Depot Driver, but I withdrew my application. I’m hoping that won’t count against me. Anyway, good luck to everyone who applies.

LU Night Tube Train Operator - Part Time

Prostate exam, penile swab, beep test... Nah, just kidding. You do eyesight (including colour vision) and hearing tests, pee in a cup for the drugs/alcohol screening, get measured (height only) and weighed, and talk through your medical form with the doctor. I may have missed something out...
