Hi there,

I recently received an email (4th March) from WmR stating I have had a misuse of my railcard. I have a 16-25 railcard but have in the past few months applied the 16-17 saver. I responded to this email apologising and saying I will pay any outstanding fares and provided evidence of my railcard. However the problem is prior to receiving this email, in late February I was stopped by an inspector for applying the wrong railcard (I thought the email was regarding this). So I cooperated and admitted to some incidents where I may have travelled incorrectly. I am now concerned I will be investigated twice for the same reason. Does anyone have any advice on this issue? On the basis of what we see here, while railway companies do sometimes go through their records to look for irregularities, we haven't heard of WMR doing this recently. So it's much more likely that the reason you got the letter is because the inspector who stopped you in February made a report and that's led to WMR looking at your records and so writing to you.

But while that's the most likely situation, it's not impossible that there are two investigation going on at the same time. So keep an eye out for any further emails or letters from WMR. The next one may in effect make it clear quite what the railway think they are doing.

And once you get their next communication, if you're not quite sure what to do next then please come back to us. We can be quite good at explaining what's going on, and what you should do next.

When I email Wmr back I mentioned this incident as they would either have this knowledge or will eventually. He responded back that they were only investigating up to end of January. I am expecting an email back with them wanting me to pay the fares back and an admin fee which I will pay, but the only concern is that it will look on their system that I have had two incidents, when they both regard the same thing.

On the contrary, WMR (or WMT, I've never got to grips with which is which) regularly do this even for 'customers' who haven't been stopped.

As I was stopped, was I right in sending the email back and explaining what has happened?

Yes. Having been stopped puts you at risk of prosecution so it is important that you engage with WMR.

If I do get a response asking to pay the fine, which I will, and then receive another email in a few weeks regarding the incident, will they believe I have had a previous issue with Wmr, even though it was regarding the same matter?

Thanks for your response. Just a bit concerned now that it may look like two incidents and it won’t look good to Wmr(when it is for the same reason) which may not help my case in getting an out of court settlement.

Do you know which train company your dealing with following the incident in February? Is it WMT or a different train cimpany?

I believe it was also WMT
That being the case, then it should be straightforward to make sure you're not investigated for incidents that have already been dealt with.

So if I am able to pay the outstanding fares and then when I receive a letter regarding the incident on February, shall I just tell them I have dealt with this previously (they should have this on their records)

Yes, that is what you should do I appreciate your response. The only issue is, is that in the email they said their investigation goes up to January 29th. I can ask in another email if they are willing to check the other dates after I have used the wrong railcard and I will be willing to pay this also. Otherwise when it comes to the 25th February incident I wouldn’t have paid this fine.

Only pay what they ask (and even then, check with your records to ensure it's ok) Don't offer to pay anything they haven't mentioned
But I will eventually have to pay for February 25th incident and apparently the investigation from the email is up to January. So will it be best to pay for the February incident now then when I do receive the email, say I have paid this previously

No that's not how it works, you can only pay them money if they ask for it - we don't even know what they will say in their next letter - dispute what they say then - You can't preempt things.
They haven't written about February yet because they're probably still investigating your case

Thanks for your response. Just concerned that they will think I have been investigated twice. So I will have to pay the fine/ fares for this incident now if they ask. When I receive the email for the February incident shall I just send another email saying I have paid a fine previously for the same incident but it didnt cover the February date

I already did respond saying I will pay for the fines and admins fee regarding the 16-17 saver (as I said in the first post). I responded as I thought this was regarding the February incident (which I now know it isn’t).

They will ask for the price of a standard single per journey. If you bought returns this will equate to 2x Single Standards with no previous tickets bought being discounted.

Just concerned about them thinking I have 2 investigations once I receive the letter regarding the February incident? If I explain I cooperated with the prior investigation regarding the same matter and are willing to pay up to the February date, do you think they will accept this?

Thanks. I don’t know if you have read this thread, but what do you think WmR response will be once I receive the letter regarding the February incident. The February incident is regarding the same matter of these fares I will pay. But I received the email to pay the other fares after my February incident

My understanding is that GWR do deduct fares already paid as a matter of course
I don't know if anyone else does

Quick question. Do WmR ask to send the money to their account with a reference to the incident, or is there a different way

There will be information how to pay via Email. Not sure if they send paper work to your address to get signed to make it more official.
They sometimes also allow a payment plan.
