On your last point. I’m not sure how courts deal with situations where an accused is required to leave the country for reasons like visa expiry before the court date. It must happen from time to time.

It maybe that someone on the forum with knowledge of court procedures can offer some information on this.

It may well be that you should contact the Pre Court team who have sent that letter to explain that you have to leave the country and indeed have received written request to leave the uk.

No one is replying for my messages and I am still worried about my future due to court proceedings. Please anyone give some advice about resolve this. Thank you.

@Puffing Devil or @island often give well informed advice on court related process so may know what happens in cases where a person who has a court case against them has been required to leave the uk.

Should I ask out of court settlement for the case 1 . Is this possible and I don't know the reference number for case 1 and court reopening the case again I submitted the appeal. So reopening by coming Wednesday. So I ask out of court settlement for this or not is this possible still. And can anyone what to add in draft for case 1 for out of court settlement .?

My view on the draft letter you have prepared is that it is essentially a request to settle out of court - so if you get that sent to them you can see what they say.

However, if this is all extremely critical to you, you may need to think seriously about getting the help of a solicitor to sort it out, given the aspects of your case that make it more complex, like you being asked to leave the UK by UK Visa and Immigration service. Of course there would be fees from the solicitor for such help.

I don't have any solicitor contact. And I don't have that much amount to spend and I am student. So wait until Wednesday for case 1 outcome. If you have sent them the e-mail I personally can see no point in telephoning them again.

You may simply have to wait for Wednesday case 1 to see how that plays out.

It might be possible for you to go to the court early on the day and seek out the Prosecutor acting for the the railway company when you get to the court and explain the situation to them and ask if they are prepared to settle the matter out of court at the last minute. You would almost certainly have to have funds available to pay the settlement sum they may ask for immediately, if they were prepared to offer that option.

You would of course have to get to the court concerned in good time, and you may have to be prepared to wait there much of the day to speak to the prosecutor. And it may not work.

I no need to attend the court on Wednesday. If anything else they call me with another date. And should I call pre court team to speak about I am preparing to pay out of court settlement immediately.

I do not think the Pre Court team at the Court will be involved in an out of court settlement for the case on Wednesday, unless you have agreed an out of court settlement with the railway company before Wednesday - ie if you agree one with the railway company tomorrow Tuesday 18th Feb and so far from your report of ringing the railway company they don't seem minded to agree to an out of court settlement with you for the case listed for Wednesday 19th feb.

You can look up what guilty means on the internet.

A guilty sentence is what will happen if the court decides you did what you are being accused of (ie travel without a valid ticket - which you say that you did in post #1) so they will consider what you are accused of and reach a verdict which would be guilty or not guilty. After the court decides on a verdict, if it is guilty they will pass a sentence, which is the punishment - in this sort of case that will be a fine, plus a victim surcharge. There is a record of this, which is usually called a 'criminal record'

Unless what is happening on 19th feb at court is for some other matter?

If this criminal records it will available in public record . And it is minor offences right? And it shows in DBs check. So I no need to want criminal records so what should to do avoid this?

a) don't break any criminal laws
b) don't travel without valid tickets as this is criminal offence
c) try to agree an out of court settlement before a case is heard in court - or employ a solicitor to try to do this for you - such as this firm

It looks like it's purely an admin hearing on Wednesday, as the court has said they do not require your attendance. Unless GWR objects, I suspect that the matter will be adjourned to a future date, some time off.

Contact the court on Tuesday to let them know that you have been ordered to leave the country and will be complying with the directions by the end of the month. Let them have a copy/scan of the letter you have directing you to leave the UK.

Give them an email and, if possible, a stable postal address in your country for contact purposes.

You should be able to reach them at the email address that you received the notification on.

The ball is now very much in the prosecutor's court.

- Delete the whole section asking for an out-of-court settlement - this has nothing to do with the court, and they are not concerned. The prosecution may pick up on this, but you have already contacted them.

The court will inform you of the outcome of the hearing on Wednesday. You'll need to wait for that for a decision.

You could email on Thursday if you've not heard.

I don't think there is anything the Court Service can do tomorrow in relation to this - it's going to be dealt with in some kind of hearing on Wednesday by magistrates.

I didn't get any outcome letter from court or anyone. I am still waiting. What should I do now wait until today?

The court date was yesterday. It will take a little time to respond to you. You could maybe chase the toc once again to see what they are saying now, following your letter and the details that they said earlier.
