Hi All ,
I just received a letter saying I'm being prosecuted for an unpaid train fine from July 2023. I've been given the option to plead guilty and avoid going to court with a 33% discount to the fine but I would receive a criminal record that would dissolve after 11 years. On the other hand I could plead not guilty and fight the case in court but I'd imagine that would come with legal fee's. I've talked to a solicitor and they said there's a possibility to plead not guilty and then put in a settlement offer with SWR to settle it outside of court but they are saying it would cost me £800 for their services on top of whatever the settlement was.
For context the train was a 5 min journey with a fare of £3.80 (Clandon to London Road Guildford). I was late for work and had to run to get on the train so i didn't have time to stop and buy a ticket from the machine , in my head i thought i would buy a ticket off the train guard as i usually do but due to the short journey i didn't see him. As soon as i disembarked i was approached by a revenue protection officer that asked me to present a ticket. I explained the series of events that had lead up to me being stuck in this situation but he was having none of it. Shortly after receiving the fine i went online and disputed it and i never heard anything back so i assumed the fine had been overturned until i received this letter.
Does anyone have any idea on how i can avoid getting a criminal record from this or know anyone i can speak to regarding the matter?
Any advice is welcome!
