There is no straight answer really, generally something that would need further investigation, but that is subjective.
If the passenger said, "I'm not paying a penalty fare", would that be grounds for reporting?

I do not think @Doomed has this option at all. As he explained, he does not live in the UK, but the RPI would not accept this and nonetheless insisted he gave a UK address - so he gave his friend's address where he was staying while on holidays.

To apply for redirection on paper requires proof of address - two utility bills, or a council tax book, or a bank/credit card/mortgage statement. To apply online requires a UK credit or debit card registered at either your old or new address, and to pass an ID check with one of the credit bureaus (I think TransUnion).

Neither of those will be reasonably possible for someone who hasn't actually lived at the address they want their mail redirected from. Even if his friend redirects his mail when he moves himself, the above would still be required in respect of @Doomed for his mail to be redirected unless they share the same surname.
Thanks for pointing this out and correcting me. I can see this aspect of the issue, a while since I last moved and did a re-direction myself so I'd overlooked this.

Hi all, I cannot thank you enough for all the information, your advice and input; I feel less emotional about the whole situation now. I think I was just gobsmacked by the inspector's behaviour and that I was made to be dishonest for the sake of their checklist but that's another matter.

For anyone interested, I have called Greater Anglia customer service line (number 03456007245) and got an email address of the prosecutions department: prosecutions@ital-uk.com. I have written them an email explaining the whole situation with relevant details (@some bloke I was hot headed and sent it before reading back your message where you kindly offered to go through the draft but thank you nonetheless).

I have just received an answer that they haven't received the details of my case yet and it can take up to 6 weeks to receive the report. They will make a note and will email me as soon as they receive further details.

For now, I will keep calm, carry on and in case there is no further answer or letter I will check back via email in July before my friends move out of their address so that there is a written record of my attempts to rectify this to show my willingness to pay and/or follow further instructions.

@vinnym70 Now that you said it I can see why the inspector assumed I tried to lie my way out of giving a UK address as I previously had a railcard. However, I'm still annoyed I have to jump through all these hoops to give the right information which I was trying to give in good faith to start with. I probably won't be the first or the last person to go through this which is frankly sad as it adds more administrative work plus the chances of resolving the issue actually decrease.

I will post a follow up so that the thread is completed with further information. Once again, thank you all and I hope to update you soon!

Thanks - sounds like you have moved it on as well as you can do. Do people know if ITAL (whoever they are) are an outsourced revenue protection service for Anglia Railways - or is this a risk that they just deal with Penalty Fares and there is still confusion around this?

I guess next steps are to:

a) keep in touch with your friend ref any post that they receive and head back here for advice on what to do in response to such post.

b) respond when they contact you. My bet is that you will receive the standard 'threat of prosecution but please tell us your side of the story or we will take you to court' letter (as can be seen uploaded by various recipients on other threads) that you will need to reply to - but with luck they will just e-mail it. People here can help you craft the reply you need to send to that to maximise your chances of a favourable (or least worst) outcome.

Good luck with it.

But certainly not just because the customer will not pay the penalty on the spot?

is there any updates now?
Hi @Woosuk - welcome to the forum!

Given that you’ve picked up on a thread that’s a few months old, you may not get a reply here: the best guess is that the problem has been resolved, but the original poster just wants to put it all behind them so didn’t feel like telling everyone the final outcome.

And we always ask people to start their own threads if there’s something they want us to help with: everyone’s problem is slightly different so it’s best that we don’t get muddled between issues. So please start your own thread and we’ll do what we can to help.

Hi all, I finally have an update. I have emailed the prosecutions department again in July with no luck. Good news though, I have received a reply to my email just this morning for which I'm very glad, because my friend has since moved out of the address. I have been offered a settlement, the standard £100 for their cost plus the £7.45 for the fare difference on my incorrect ticket. So all things considered, it was a good outcome, just a bit surprised it took 5 months.

I paid the amount via their website and get this - when I was asked to enter my phone number, it didn't take my actual international number so I had to use my friend's UK number. So... I had no choice but to provide incorrect personal information, yet again.

I'm happy I can close this case and not have to think about it anymore. However, I am still bothered that the system both in person and online makes it impossible for people to ensure their personal records are correct, which is not in accordance with an article of UK GDPR where data processors must take reasonable steps to ensure the accuracy of personal data. Hope this thread might help someone in the future; my advice is be proactive and try to get things in writing for future reference. Ta everyone!

Thanks for updating us. This is a reasonable outcome given the circumstances.

Now that the matter has been resolved please do consider making a complaint to Greater Anglia about the problems you refer to in your post.
