Well, I feel strongly about it as well, as I have vivid memories in a previous life of lots of delay being caused and cautioning trains and speaking to very distressed drivers.

Unfortunately we've moved into an era where comedy is no longer clever wit and irony, instead causing distress and harm to others and making a prat of yourself is apparently funny - even better if that's recorded to history for all to see.

If the're filming that is iligal because of the terrorism act...

Just read it and filming land intended for public transportation is an offense under the terriorism act for which they can be charged and sent down, by CCTV, albeit only a 28 day detention order, it would make them think twice about doing it next time if they did it.

Whereabouts in the terrorism act is this? I appreciate that the possession of information such as info about public transport infrastructure where it is suspected to be for terrorist purposes is an offensive but can't see anything which make reference to "land intended for public transportation" or similar.

It's burried in definitions in other acts, basicaly, because the're videoing operations on a station, if there is a CCTV camera or peice of security or safty equipment in shot anywhere, they can be detained

Signals, Help Points, AWS and TWPS count as H&S Devices... The AWS/TWPS/Signals on filmed location is possibly the easyest to get them on, remember back in the days of train robberies?

That sounds like a load a rubbish. It isn't illegal to film on a railway station.

not in statute law it isn't, but in broadcast regulations and most local council regs, aswell as the parlement law of the terrorism act, and of course the crown law of the mental health act, I think it's because the're just too many diferent laws over here.

If the're endengering themselves then I'd go for the Mental Health Act, endangering passengers, Civil Law, if they so much as look at a CCTV camera in the wrong way the Terrorism Act can be used. Then of course theres the Public Disorder Act and ASBOs ;)

Stop talking rubbish. They arn't going to be arrested for just looking at a CCTV camera or filming on a railway station

It was a hyperbole about looking at a CCTV camera in the wrong way, but it got my point across about using the terrorism act.

Smoking on stations, erm, I erm, never, erm, smoke, on erm, stations ;)

If I did it wouldn't be inside the trainshed, but why ban smoking in victoria, the smoke you breath out is cleaner than the fume filled air you breath in! Espcialy when the 185s are diverted into there, or a pacer sets it'self on fire...

Nym, that is absolute rubbish. I have asked on a legal forum and also briefly searched the internet and scanned each Terrorism related Act passed since 2000 and there is nothing of the sort. I know the Labour Government have a thing for breaching our Civil Liberties, but there is nothing of the sort in any act, and if there was it would be a blatant breach of the European Convention of Human Rights.

Filming CCTV, however, is regarded as suspicious behaviour and could possibly render you likely to be investigated by the police but you cannot be prosecuted for such an offence. I can only assume the 28 days you are talking about is the 28 days that a Terrorist subject can be held without charge.

Because you had reasonable cause to suspect someone of preparing to commit an act of terrorism or otherwise?

Just because someone has been arrested, it does not immediately mean they are guilty of such a crime, or that even a crime has been committed.

I arested this man and woman under the terrorism act, but then they where later charged for trespassing on crown property, if I know the perticulars of ownership for railway land I'd be able to tell you more, so far I'm asssuming it's a security sensitive private (plc) land?

There are very few laws on non-commercial filming. You could be charged with a number of things if filming people for a tool of harrassment or given an ASBO. ISTR a man who was filming ladies at York station was given an ASBO or similar for such activities.

There are a small number of local authority byelaws on filming too, but such are rarely enforced and because they are minor laws carry minimal penalty. Prosecution under such laws probably would rarely even pass the CPS' "Public Interest" test when even decising to prosecute - unless a private prosecution takes place.

*If* you are suspected of doing a number of terrorist-related activities, then you can be detained for twenty eight days. This does not mean you are guilty of any offence and is not a punishment. If you are a cynic it is to be used for dissidents of the Government. If you are not it is to be used to protect the public and gain enough evidence for the prosecution of an individual.

Similarly looking as though you're going to jump infront of a train may also be construded as an offence by forcing the driver to perform emergency procedures which are in themselves dangerous, it is endengering that life of the driver and all persons onboard that train. Therefore an offense.

It is also iligal under the highways act and even the special roads act to perform hand signals at any peron(s) on a road or perminant way ;) That carries an unlimited fine and 2 years :D

There are many diferent things you could get this bunch of idiots done for, the easyest would be to do them under the terrorism act for filming in an un-autherised location without a permit, as this endangers the security considerations of the station land and the perminant way.

But if filming on any station, NR request that you check in with any staff and let them know why you are there.

Failure to do so can result in NR asking you to leave on that occasion.

Right then so, unless i have a permit and authorisation to film on a railway station at the edge of a platform in the middle of January i'm breaking the law along with all the others at Warrington or Newport? Doesn't add up.

I've been stating facts and scopes of acts of parliment and the crown, I arested somone under autharity of the queen on MoD designated property, prior to the end of my 20min detainment rights, they where arested by the MP then handed over to CP and charged with crown trespass!

Photographing on MoD property is entirely different from photgraphing on a Railway Station and is covered by completely different legislation which is, quite rightly, designed to protect national security. As a side point, I know someone who snuck Channel 5 TV cameras into a MoD site once as they are making a TV show about railways in the UK!

Interesting to hear more about you arresting someone but back to the discussion, you keep mentioning this law and that law but you've yet to provide any solid references to what particular law is worthy of note here in relation to the original topic.
