FCC can and do issue Penalty Fares for Greater Anglia and have done since the beginning of the FCC franchise. It is written on the back of warrants for all inspectors.

Thanks for clarifying this, but it is interesting that neither Greater Anglia's or Capital Connect's Penalty fare schemes authorise this. I shall make some enquiries with the DfT about the status of this shortly. As Greater Anglia's Penalty fare scheme provided under FOI is newer (on account of them being a newer Toc than Capital Connect) there must have been some point at which Penalty fares should not have been charged.

Penalty Fare notices have a section for the name of a parent or guardian if the notice is being issued to a minor.

On Penalty fare notices used by the Tocs I have noted that there is a space for details of parent/guardian for Under 18s, but of course said person is neither legally obliged to provide this information or nor may they even have one!

It strikes me that FCC (?) are digging a hole for themselves. From what you say, it seems that they have failed to take note of and properly consider your appeal, which is a requirement of the scheme and also a requirement in common law.

It's IPFAS that I wrote to. Though I imagine a letter to FCC wouldn't go amiss. Gonna cost a load in stamps.

I suppose if an RPI was told by an under 18 that they had no parent or guardian the BTP or such would be dispatched sharpish. I'd expect them to be anyway.

As for whether FCC RPIs are allowed to collect GA Penalty Fares, for the time being I'll assume that they are.

Yes, Deerfold is correct - I had in mind the instance of a 16 or 17 year old who did not live with a parent or guardian, for example someone who lived with their partner, in a hostel or elsewhere.
