Not a dispute as such, but this seems to be the best place.

If I get on a train at Whitby, intending to pay the guard, have I missed the first opportunity to pay if the NYM railway's ticket office on the station (where you can buy national rail tickets) is open? Or is that irrelevant as it is unrelated to Northern rail?

Looking at the latest version of Schedule 17 to the Ticketing and Settlement Agreement (available for download from this page) Whitby does count as a regulated station for Northern, with opening hours of 0830 to 1300 and 1330 to 1600 Monday to Saturday, and using FasTIS.

As such, I would suggest that a failure to purchase a ticket before boarding (assuming the "Ticket Office" is open and FasTIS is working) would leave you liable to pay the undiscounted Single or Return fare for your intended journey, in accordance with Condition 2 of the National Rail Conditions of Carriage.

Short answer, no.
You need the appropriate ticket for each operator. NYMR tickets used to be available on Northern (but not vice versa) but that stopped a couple of years ago.

Technically possible but realistically very unlikely on the North Eastern bit of Northern Rail (the North Western bit however...) unless you refuse to actually buy a ticket.

Whitby station does have a ticket office (it's not relevant who operates it) and this is listed on the National Rail website, so if it is open, then in theory the Guard could charge for a full fare Anytime (Day) ticket with no Railcard discounts.

Though for most people that's probably the fare they want anyway (e.g. Whitby to Middlesbrough doesn't have any off peak fares).

Correct, but it does have Northern Duo and Esk Valley Railcard discounts. I have seen both refused by those boarding at Middlesbrough.

When I was at Whitby a few weeks ago i recollect there was a notice instructing purchase in the Office, not on the train.

Just as an aside Duos are only available from Whitby TO Boro and not Boro to Whitby (The furthest you can get a Duo to from Boro on the Whitby line is Nunthorpe)
