Welsh Highland Railway Question

I understand that part of the reason why the rebuilding of the Welsh Highland Railway has progressed so rapidly is that the railway was never formally abandoned, so that has cut down on the amount of red tape involved. However there are a number of level crossings on the line and given the attitude of the H&SE that they want to discourage new level crossings I was wondering - If the H&SE had said they would not permit these new crossings, would the WHR have been forced to replace them with bridges or did the fact that the Act permitting construction of the WHR was still in force overrule any objections the H&SE might have?
