I had already sent a rather snotty e-mail to Virgin before I was offered the upgrade and they have now replied offering a refund in the form of Travel Vouchers that added to the upgrade is I think incredibly generous of them
Take it!

At the end of the day its them making the loss.

If I was upgraded to first on the next train, I wouldn't claim even if I could becuase the TOC has done the 'right thing'. I have not lost out financially, so why claim?
.

There are many circumstances, though, where you could lose out financially - e.g. you were going to the theatre and missed the event you had paid for with no possibility of a refund; you were going to meet a potential client and as result of your non-appearance you lost the business etc etc.

In such circumstances, even though the TOC had 'done the right thing' with an upgrade, I would certainly expect more. If I was merely going home I would be less bothered.

In this case Virgin did provide extra compensation which the OP was happy with.

Well, yes, there are plenty of things like those examples. Except, in those situations I would have said a first class upgrade was pointless as I no longer had any need to travel because I'd missed a meeting/theatre or whatever.

However, if those examples hadn't happened then you've only lost time, so what I said still stands.

I didn't say that you should never claim. I have claimed before, but won't bother if I haven't lost out. Some will argue that I'm stupid and the TOC benefits given they get compensated for delays outside of their control, and they may be right, but I still think I'm simply being fair to them - as I'd expect them to be to me.
