Hello
I was stopped by member of underground because I was used zip card.More then 5 weeks pass and I still don’t get letter to explain why I was using this zip card.
I arrived two years ago because of war in my countryand here in London some peoples advise me to do it because it’s cheaper. And it was really helpful because London life is so expensive.
I was travelling with it from Finchley Central to Totteridge and Whetstone.
Can I call to some number to check with them that I did not get letter?Im afraid because I’m moving out in one week and want to solve the situation happened.
Anyone can help me pls?
Regard

Hi.

Is this a TfL zip card that you used please?

If you have any correspondence about this it would be useful for the experts to see it. Cover up your name and address and any reference number.

It is unwise to poke the tiger who has the ability to give you a criminal record. Moreover, the customer service department is unlikely to be able to give you any information or communication from the prosecutions department.

If you are concerned about the reception of correspondence and no one is available at your current address to notify you if something important arrives, you may consider a Royal Mail redirection service to your new address.

TfL take zip card misuse very seriously and they are likely to proceed with a prosecution under the TfL byelaws. Others will be better suited to advise on the exact amount but you should be expecting a court fine on the order of hundreds of pounds, depending on your income, with a discount if you plead guilty at the earliest opportunity. We are unable to advise by law if the criminal conviction will affect your visa or residence status, and you may want to talk with Citizens Advice on that matter if you are concerned. The criminal record will not show on most basic DBS checks, and will generally be struck from the record after a year at most. (Exceptions apply; employers entitled to said exceptions will tell you about it.)

I’m sure you fully appreciate the fact that you are guilty of a criminal offence. By entering the United Kingdom you also commit to following its laws and regulations irrespective of personal difficulties and I’m sure you need no further reminder to always pay the correct fare in the future.

Moreover, if your forum username is related to your real life identity you may want to ask a moderator to change it.

They deal with cases in order. You can't skip the queue.

Below is a list (with links) of recent cases involving TfL in the Disputes & Prosecution forums (excluding on-the-spot penalty fares). As you can see, TfL typically have a very fast turnaround, sending out letters within 1-2 days of the incident, and if deciding to prosecute then sending out the Single Justice Procedure Notice (SJPN) after another month or so. I could only spot one example (bolded) where there was some indication that a letter might not have been sent out within the first few days. Based on this, in my non-expert opinion, if no letter has been received after 5 weeks then I would normally say that it is very likely that TfL has sent out a letter but it got lost on the way.

However, TfL is currently having IT issues due to a cyber attack that was discovered on Sep 1 - perhaps someone with insight can say whether they have stopped/slowed down processing of fare evasion incidents (particularly ones involving misuse of someone else's card where TfL may want to investigate journey history)?

Incident on Sep 19, letter dated Sep 20 received Sep 23-27 (Tailgating someone through barriers)
Incident on Sep 3, letter received by Sep 5 (Misuse of someone else's Freedom Pass)
Incident on Aug 16, letter received unknown time, response sent, SJPN dated Oct 1 received Oct 10 (Tailgating someone through barriers)
Incident on Aug 5, letter received by Aug 9
Incident on Jul 30, email sent Jul 31, email response received Aug 5 saying couldn't find the incident in TfL's systems (walked through open barrier without ticket)
Incident on Jul 25, letter dated Jul 26 received by Aug 2 (Misuse of someone else's Freedom Pass)
Incident on Jul 17, letter dated Jul 19 received by Jul 23 (Misuse of 60+ Oyster)
Incident on Jul 15, SJPN dated Aug 20 received by Aug 22 (Tailgating someone through barriers)
Incident on Jul 11, letter received by Jul 17 (Tailgating someone through barriers)
Incident "early July", letter received "shortly after", response sent, SJPN received "about a month later" (Misuse of someone else's 11-15 Zip card)

Going right back to this, it looks as if you need to let TfL know about your new address. TfL’s website doesn’t give a specific contact for their prosecution office, so try their general contacts at the bottom of the page at https://tfl.gov.uk/help-and-contact/

Apologies - I hadn’t picked up on them having told you they could find no trace.

It’s most likely that there’s nothing for you to worry about, but just in case keep full details of when they told you there was no trace. If it was a letter or email, keep it; if it was a phone call make a note of as much detail as possible - if you can, the exact date and time of the call, what number they called you on, what number they called from, the name of who Called you, and what they said. That way, if anything does happen you will be able to show why you didn’t do anything more.
