Used brothers railcard

Hello,
I used my mates railcard on TPE pretending to be him, i never gripped how serious it was. In a blind panic, I admitted the whole thing to the train guard and they issued a travel irregularity report. Now waiting to hear from them by post.

What are chances I can agree an out of court settlement?

It says it could be prison time, but surely this isn’t the case for a first a offence?

I most definitely have learnt my lesson and I’m obviously kicking myself for being an idiot. I did it because i’m skint and my railcard expired 1 week ago. Any words of wisdom would be greatly appreciated.

Good news is you won’t be going to prison however it is still a serious situation you are in.

Is this the first time you have done this? Basically what will happen is they could look back at your ticket buying history (trainline, trainpal etc) and find all the times you have done this previously if you have. If you cooperate with them and ask they may offer you an out of court settlement. The experts here will offer you terrific advice on how to write/reply to them.

If you don’t reply or you try and lie to them they will be reluctant to offer you an out of court settlement.

Hello, what would be the best way to go about dealing with the situation of them looking back at the ticket history and trying to recover ticket fares for the past year? This happened to a relative after they paid a penalty for a single journey to which the train company agreed to settle upon instead of court and now they have written back to them asking for proof of having a railcard for the past year...they had the family and friends railcard but ended up using 16-25 option.

I'd go further than that; TPE would, in that case, almost certainly offer an out-of-court settlement.
