Upgrading to 1st class on a train already more than half an hour late

Over the past few days I've seen Avanti West Coast trains full and standing in standard, running sometimes nearly 2 hours late. 1st class on the other hand was largely empty. Assuming any standard ticket holder could sit in 1st class then pay the difference in fares when challenged, could both the original fare plus the excess be valid for delay repay?

If the delay is already known at the time of purchase, there is no automatic entitlement. But you may well get it anyway.

Interesting, but don't suppose they advertised this to those poor souls strap hanging (if only there were straps to hang off) between Lancaster and Carlisle......

Agree with Bletchleyite In the case of one I was on last week, it was physically impossible for the train manager to get down the train to take payment from those wanting to upgrade.
