Hello guys

Has anyone experienced discrimination from GTR. I have applied for a job but the OH team seem to be making an issue of MH issues that were the result of the pandemic and parental alienation.

They have been making excessive and illegal requirements and to be honest I am not impressed by the organisation. The OH nurse seems to be implying I am unfit to work ???

This despite working for 15 yrs in a high profile organisation and working throughout my life.

I am very concerned and it appears to be illegal

That’s quite an accusation! Railway occupational health teams are good about mental health issues in my experience - however obviously there are limits, especially where certain medications are concerned.

That isn’t in any way illegal - ultimately they need to be satisfied that you’re (both physically and mentally) capable of doing the job you’ve applied for safely.

I’d suggest working with them to understand what is required is going to be more fruitful than claiming “discrimination”, which is completely legal in this context.

I don't want to be overly harsh, obviously I'm not a doctor and don't know your circumstances. But you blame the pandemic, and ' parental alienation'.
Then attempt to suggest that they're a rubbish organisation Who are discriminating against you. Could be interpreted that you'd be quite a difficult person to work with, as you are very quick to make excuses and throw quite serious accusations around.

Personally I'd suggest 2 things. Firstly , the railway, like lots of industries can be quite a small world. The specific info you have posted could quite easily get back to the people involved and identify you, further harming your chances.

Secondly, maybe try and take what they're saying on board. Work with them, maybe ask what they'd like you to do to demonstrate 'fitness to work '. If you still want employment with them. It will be a lot better for your chances if you work with them, rather than be obstructive.



If it doesn't work out, and you really think you've been discriminated against then by all means speak to a solicitor. But these are very strong accusations to be making, considering you are in the process of trying to gain employment

To be honest you aren't exactly coming across as a person who's worked in a "High profile organisation".

Sounds like you've been knocked back from a job due to GTR OH taking into consideration your mental health state. Not sure what job you have applied for, but if it's anything safety-critical then mental health is a big deal and as an employer, they need to make sure that your mental health will not potentially put colleagues or members of the public in danger due to you potentially having a tough day with these mental health struggles.

Then you jump on a forum which most of these TOC's know about and look at regularly and start bad mouthing and crying discrimination from the rooftops.

If you feel they have genuinely done you wrong and not professionally assessed your health in whatever capacity for the role you applied for, speak to GTR in the correct format expressing concerns you may have. At the end of the day, they have the choice of who they employ and they do not have to justify to you why they do not want you as an employee.
