Most did, in that they failed to pay a Penalty Fare and then the matter escalated. But certainly not all.

Nexus are very content to prosecute people, even students being foolish.

If a Penalty Fare was issued they may pull the prosecution if there are mitigating circumstances as to why the Penalty Fare was not appealed or paid within the time limit. Otherwise, generally they don't do out-of-court settlements in my experience, Nexus (like TfL) see value in prosecution because of the message it sends.

Just to add to my previous post, there is usually a short timeframe in which to submit a plea to Court. The OP would do well to pay attention to it.

If you feel comfortable doing so, I would suggest you call Nexus on the telephone number provided as a matter of urgency. If you do not feel comfortable, I would suggest you contact an advice agency for their help as a matter of urgency.

If you're a student then your university's students' union will be the best option, if you're not then Citizens Advice Newcastle should be able to help. When contacting them, tell them you have a Court deadline.

You have 21 days to file a plea with the Court from the date of the form. If you intend to plead guilty, you should also complete the statement of means. This is very important if you are on a low income as the Magistrate can take your income level into account when deciding the size of the fine.

Their stance may have softened in the last six years, so the OP should definitely do as above.

My experience working in Tyne and Wear for many years was that they would only consider 'alternative resolutions' where there were mitigating circumstances in play, and that 'alternative resolution' would be to allow someone to pay a Penalty Fare late. For other types of prosecution they were often a lot less willing to play ball.

The timescale is short and the OP needs to make sure they have spoken to someone. I would strongly recommend phoning or getting someone to phone on their behalf, as emails can (and do) get lost in the ether.
