Hi, I made a big mistake today. I didn't realise that my system one 28 day pass had expired by 2 weeks. I know I was stupid. I had the previous months pass and the current one which i thought was in date in the wallet. I showed it to the ticket person on the train who noticed that it was 2 weeks out of date. I have been so busy/ill recently that i just completely forgot that it had expired. I was very apologetic to the man and offered to pay the fair immediately which i did. he told me to go to the end carriage maybe to get a clearer picture of me of their cameras. he also took the old cards off me and instead of chip and pin my debit card, swiped it and made me sign. I'm fine about paying a penalty because it was my own stupid fault for not realising but could it be prosecuted/taken to court. It was on a nothern rail train. can they get my details from my bank card. also the passes he took off me have a unique code which matches with my photo Id. As i said I would be fine with paying any fines as it was my own stupid fault but could It be taken any further.

Where an Inspector wants to find out the name and address of a passenger, whether it is for issuing an invoice for a fare, for sending correspondence about an investigation, or simply for verification that the person is who they say they are, then they tend not to use techniques of tracing the account holder of a bank card, matching images from CCTV, or holder of a rail pass. They tend to ask.

If the Inspector didn't ask you for your name and address, then I wouldn't expect that you'll hear any more about it.

It seems to me that you were asked to pay on the spot, in order to correct the unpaid fare (due to the expired pass), and so there is no more to be done.

I agree with DaveNewcastle. It is almost certain that having paid your fare on this occasion, the matter is now closed, and that the expired tickets went in the bin at the end of the guard's shift.

Naturally you should ensure no such incident arises again.

The pass was valid for 28 days and was 14 days out of date, yes?

I would say you were lucky the guard dealt with it in this way, it could very easily be prosecutable, 14 days out of date is some mistake!

Just be more careful in future, you were very lucky this time.

And your old tickets were taken away so you dont make the 'mistake' of using them again. They will have been either ripped up or perhaps put on a notice board. We have a nice collection of out of date passes and esp YP cards on ours. The last one I put up was a yp card that was 9 months out of date.:|

I must admit to having almost accidentally used a 12-month out of date YP card last year! Thankfully I noticed when collecting the ticket but as I had been using season tickets for 9 months it never occurred to me that my Railcard had expired  It is remarkably easy not to notice the date.

Thankfully I managed to get a new 3-year card delivered just in time. Don't like paying £7 for postage but its better than a £25 excess or god knows how much penalty fare!

You can't excess the lack of a railcard so it would either be a whole new ticket or Penalty Fare.

Every time I see one close to expiry I recommend the owner sets a reminder of the date on their phone.

It is not in the rules but it is technically possible.
