Hi All,

I was travelling from my home (Zone 6) to London Victoria station (Zone 1) one week ago with Southeastern Railway.

When I entered to the St Mary Cray station (there are no gates in the station) and I forgot to touch in due to limited time for me to catch the next London Victoria Train. Thus, I have entered to the station without touching in and and realized that I have forgetten my annual travel card back in home. When I have arrived to the London Victoria Station, I was checking the mobile app of Southeastern Railway to buy a ticket. At that time, I just thought it may make sense to buy a daily return ticket from the Southeastern railway app not to incur any penaly with contactless. However, the app did not show the train that I took in the morning since the time was 45 minutes ago and I thought I can maybe buy a ticket for the last train from Denmark Hill. But the mobile app did not show any tickets and there was only a white screen when I tried to buy the ticket. Then, I went to one of the Railway employees asking how can I buy a ticket from Denmark Hill. She was suspected and asked me how did I come from Denmark Hill saying that there are gates in that station and I can not enter without touching in. At that time, although I did not come from Denmark Hill, I asked how to get a ticket from there just thinking that both St Mary Cray and Denmark Hill are on the same route and Denmark Hill is close to London Victoria. However, the representative starting questioning me thinking that I was trying to evade the correct fare. I could not even explain myself clearly and I find myself accepting I deliberately tried to buy a ticket from Denmark Hill and I did this one more time before.

I was so shocked with the questions asked to me at that time as I have never experienced a situation like this. I said I was coming from Denmark Hill but later I was worried and regretful and told that I was coming from St. Mary Cray. I am so sorry for my silliness on that day and want to settle this case out of court as soon as possible. I did not know the seriosity of these cases. The representative has asked me some questions and issued an M11 witness statement. One another representative has taken a photo of my ID and personal details (name surname, home address and DoB) and they wanted my signature on some of their notes on a white paper.

I have been reading some other people's blogs about this type of incidences. It says the railway company might send a letter asking for a penalty payment or they ask some questions and if the answers are not satisfactory, they may even prosecute the offender. I have taken my lessons learnt from the case. I want to solve this issue out of court with paying the maximum fare for the travel and any additional costs the SE railway has incurred. After the revenue officers issuing the MG11, they allowed me to touch out with my contactless card. Later, I have also corrected the station that I have started my journey through my TFl online account. My bad luck is I was afraid to say I had an annual travel card and forgotten that one back in home since my wife had also used it for some time earlier and I did not know if that was allowed. If I had informed the representative about forgetting my Zone 1 to Zone 6 annual travel card (valid until the end of 2023) back at home, it might have been different. But due to the shock I had at that time, I was afraid to tell that. I have accepted things travelling deliberately without relevant ticket and doing this earlier.

I want to understand if it makes sense to wait for the train company to send a letter or should I call the prosecution department and tell that I have learnt from my mistake and I would appreciate agreeing on out of court settlement. Also, would it help if I tell that I have an annual travel card for the relevant zone until the end of the year. I am deeply regretful and worried about the situation. I will never enter without touching in and never behave irresponsibly like this again. When the revenue enforcement officer interrogated my intention to buy a ticket from Denmark Hill, I was honest and accepted that due to its being cheap in there I was planning to buy a ticket from Denmark Hill. But this was not the only reason, my train from St Mary Cray also did not appear at that time. This is the first time I am warned. Lastly, they did not offer me to pay for the full ticket price on the day instead directly taken my comments and issued an MG11 witness statement since I said I have tried to buy from Denmark Hill due to its being cheap in there and I did that one more earlier. I want to proceed wisely and solve this issue before it gets worse. I would appreciate any advise from your side.

Should I contact them before they sent any letter and tell that I am regretfull about the situation and I want to agree on a out of court settlement?
Would it also help if I tell them I have annual travel card but forgot that one on that day? I have the order details, payment proof and journey history for my travel card but unfortunately there are some times that my wife had also used it.

Welcome to the forum.
What does the OP mean by "annual travel card"? A Freedom Pass? A season ticket? A discounted Railcard (eg Senior)?

There's plenty to question here, but I'll leave that to the regular contributors who will no doubt reply soon enough.

Meanwhile, a question. Did your wife go also travel on the day this issue arose? If so, did she pay for a ticket in the normal way that would not arouse suspicions of the railway company further?

Hi - I think given what you have said occurred, and what you did, you need to proceed with caution now

Should I contact them before they sent any letter and tell that I am regretfull about the situation and I want to agree on a out of court settlement?

No - the general advice given here is that you should wait to her from them as they will send a letter (not might send a letter). There are various reasons for this but they boil down to
a) they will not be able to easily match their case records up until you have a letter and a reference number. Ringing them up now is likely to just complicate and delay things further
b) when you get a letter you can make sure your reply is focussed on what they are asking you, buy ringing them up you may say something that implicates you further and potentially makes things worse. This is not what you need to happen.

Would it also help if I tell them I have annual travel card but forgot that one on that day? I have the order details, payment proof and journey history for my travel card but unfortunately there are some times that my wife had also used it.
I would be very cautions about telling them this, although you may need ot be clear in stating here what sort of Travelcard it is. If it is a Travelcard that is 'Not Transferable' that usually means only you should be using it. If they establish that your wife has been using it when that is not allowed your problems will increase considerably. So drawing attention to that is not a good idea.

I would advise you to check as soon as possible if the Travelcard can or can not be used by your wife. If it can not be used by your wife you need to prevent this happening from now on, since if they find out about it it increases the chances of them prosecuting you in my opinion.

People here will be able to give you accurate advice on the riles relating to your Travelcard if you are able to state clearly what it is (name of Travelcard, who issued by / where bought from etc)

Hope this helps, but for now you need to wait to get the letter from the Railway company.

Thanks for your advise @WesternLancer I have purchased annual zone 1 to zone 6 travel card for adult and I have implemented my annual adult travelcard to a blue oyster card.

Also for @FenMan, on that day my wife has used the oyster card after a few hours.

What, exactly, is the ticket on the Oyster card? Is it a season ticket issued in your name?

This may turn out to be very uncomfortable for you if they discover it.

Also, since I have corrected the station that I have started my journey my contactless card journey history shows that I have paid the correct fee and the station where I started my journey is correct. Can this be a proof that I learnt from my mistake and corrected it.

She isn't supposed to use it then, and if they do their homework and discover you have a season ticket - that was used on that day, it will harm your defence that you left it at home and were trying to sort yourself out.

I recommend you do not bring it up unprompted in your discussions with them, because doing so will implicate your wife who has also been committing offences. This avenue of questioning will be impossible for you to navigate without making things worse for you and her.

There are a number of questions which TfL may want to ask you about this and you should use extreme caution in how you respond.

I was assuming it was SE Trains that have stopped the OP (Ikser) on attempting to exit barriers to Victoria mainline / overground station, and thus it will likely be SE Trains the OP will be dealing with, not TfL.

However, your key point about the OP's wife using a ticket issued to the OP only for the OP's use is the vital point here and I would agree with your points on that.

Isn’t it unusual to have the suspect touch out with contactless when they’re reported like this? Aren’t they normally given a slip of paper with which to complete their journey? Does the fact that the OP has paid for their journey (and, indeed, was told to do so) give them any kind of defence here?

Isn't there enough on here to identify the OP, or at least narrow it down a bit, for SE Trains? I'm sure they have people who read this forum.

Yes.

Yes.

Unlikely. The offence was committed the moment the OP stepped onto the train without a valid ticket, and cannot be uncommitted by subsequent irregularities. Two mistakes do not "cancel out". The OP should be able to claim the sum back if he wishes.

It’s really up to the OP to contact us regarding this kind of thing…
Obviously we’re happy to look at it if they want to edit anything, but this sort of concern comes up quite often in this section and there’s only so much that we can do as we can’t read every post in every thread.
The best thing we can do for now is this:

@lkser - If you want to edit your details so that they’re more anonymous, please contact us via the report function below.
