transpennine express delay compensation

this form states that compensation is paid for delays of over 30 min for failures of the railway industry

I had an anytime return CRL-MIA with reservation on the 0717 service:
1U53This service was cancelled between Manchester Piccadilly and Manchester Airport due to animals on the line (I8).

On approach to Piccadilly passengers were advised to wait for the following MIA service from platform 13: 1M90 although there appeared to be a train to the airport at platform 3 leaving earlier than the above ex Glasgow train.

As 1M90 arrived MIA at 0850, and 1U53 was due to arrive 0817 am I due compensation, or is animals on the line not a failure of the railway industry?

If I am due compensation, what is my best approach?

Send in the claim, and see what happens.

TPE will be compensated by Network Rail, you can be sure of that!

As for whether it's a "failure of the rail industry" it probably depends on the definition, and on how the animals came to be on the line. A hole in the fence is a rather different story than, say, a farmer not using a level crossing correctly.

The animal in question was a horse. TOCs were advising people via Twitter to send in delay repay claims; and I see no reason why you shouldn't get at least some of the price of your ticket back.

TPE Does not do Delay Repay.

The list of things for which Compensation IS payable is:
Signal Failure
Track Problems
Following another service, as long as the original delay is not as a result of an area on the "not payable" list
Connection not held
Engineering Works not preplanned and advertised
Overhead line problems, as long as not weather related
Power failure, as long as not due to cable theft / vandalism
Fail to Stop

The list of things for which Compensations IS NOT payable is:
Cable Theft
Vandalism
Weather
Flooding
Trespass
Fatality
Animals on the line
Road vehicle striking a bridge
Fire
Scene of Crime
Security Alert
Gas leak
Problems with property adjacent to the railway
Police request

That seems mostly reasonable though the animals one could be dubious depending on how they got there ;) as for fire, presumably that's for landside fires? I know on-train fires are very rare indeed but I'd expect that to count ;)

Still worth submitting. I did one in the post Christmas bad weather for delays directly associated with the high winds and TPE honoured it

We were unable to operate trains for a period of time due to an animal blocking the track between Kearsley and Farnworth Tunnel. When such problems arise every effort is made to clear the line as quickly as possible and we work closely with Network Rail to minimise the disruption to services on the line. We share your frustration, but there are some times when incidents occur that are outside of anyone's control.

The failure to provide any aspect of our advertised service is always very disappointing but I am sure you can appreciate that we would not have had any insight into the problems you encountered and as this disruption was outside of the control of the rail industry, compensation is not available for this type of event. Our Passenger's Charter, available online or at stations, gives more information on the compensation scheme we operate.

Thank you again for contacting us and I do hope that you will continue to travel with First Trans Pennine Express in the future.

The one thing that gets me, is that if the original train had continued to MIA, the delay would have been less than half an hour, so the rail industry WAS in control of the length of my delay, and I assume anyone who was sat waiting at MIA for the train back up to BPN would have been told that the cancellation was due to a horse also.
How much of a knock on can be blamed on the original incident?

TPE compensated me £10 last year because of a trespass and a bridge strike. The letter said that they do not normally compensate for these but in my particular circumstances they would.

Both delays happened on the same day
