TPE Delay Repay Dispute

I intended to take the following journey on 27/04:

12:46 Avanti Holyhead to Crewe arriving 14:52
15:10 Avanti Crewe to Manchester Piccadilly arriving 15:44
15:58 TPE Manchester Piccadilly to Leeds arriving 17:10.

The 15:58 TPE was cancelled, quelle surprise. I got the 16:30 which arrived at 17:42, 32 minutes later than booked arrival. The 15:10 Avanti was also late, arriving 15:56.

TPE are adamant they aren’t at fault, and instead Avanti need to pay up. But they’re refusing to pay more than 15-29 minutes. I would think TPE need to pay up, as it was their fault I had to wait half an hour in Piccadilly. What are people’s thoughts please?

Avanti are responsible for a 32 minute delay. They caused you to miss a booked connection. The fact that the connection did not in fact run is irrelevant - the average passenger would have no way of knowing that (unless diligently tracking their journey on a travel app), as they wouldn't have enough time at Piccadilly to notice.

Yep, agree with ALR here. Avanti are who you should have claimed from, as their laterunning would have prevented you from catching the 15:58 if it had been running, unless you were positioned in exactly the right place and we prepared to run. The fact that it didn't run is therefore immaterial.

Having submitted your claim to the "wrong" TOC doesn't disqualify you from Delay Repay but be prepared for TPE to send your claim over to Avanti upon appeal.

However the amount of delay claimed for is not the amount incurred in one leg, but in the actual arrival of the passenger at their destination.

The next available train was taken, and would still have been the next available train had the original tpe run (2 minutes not being a valid connection).

So the delay amount is still 32 minutes regardless of who pays for it.

Indeed if the Avanti arrived at 1756 there could be no expectation of making the 1758 if it had been running as planned; you'd have to be first off the train in just the right place for the footbridge and walk very rapidly and hope the despatch sequence wasn't started too early to have any chance; expecting that to happen is completely unrealistic!

If the Avanti had arrived at 1748 or earlier then TPE would definitely have been liable.
