The coming copyright rules and this forum (?)

As I see it, forums like this will be able to link to news items (eg from a newspaper) but, unless copyright permission is granted/paid for we won't be able to actually quote from the source - thus we can't appy the sites conditions.

1. Is the above vaguely correct (I can't get my head around the new directive!)
2. If so, what can we do about it for members relying on spoken text?

As this is an EU issue it's possible, but unlikely, that it won't apply in the UK but as I understand all EU laws will be made UK laws.

There is already provision in the UK Copyright, Designs and Patents Act 1988 for "quotation, criticism or review" which would cover the typical way in which we refer to third party articles.

Will that continue though after this new ruling?

As this is a directive, it will, (presuming it passes at the final vote next year) set out what the law of all the EU member states needs to achieve, and provide a period of time for national laws to be amended where necessary. This is usually a period of some years so if this forum is affected, precisely how won’t be entirely clear until (unless) British law reflects the amended copyright code. For simplicity and reciprocity, British copyright law is reasonably likely to stay in line with EU copyright law post-Brexit, whatever the wider future arrangements are.

Of course it is possible that web hosting companies or other intermediaries will implement policies which affect this, in the interim.

Whilst the directive has, sadly, passed it is not yet in effect in UK law therefore nothing is changing at the present time in terms of the Forum Rules (and our web hosts are also UK based). If and/or when UK law does change in line with the directive we will of course review our position then and be sure to inform the membership of any changes that come about

The application of the ruling in the UK will be affected by what type of Brexit we get. Although the UK may want to follow the ruling so it's best we wait & see. A way around the ruling could be to move the forum's servers outside of the EU.

Does the ruling apply though to servers hosted outside the EU but used by people with in the EU?

The laws on data protection certainly do.

Perhaps they could also implement a law stating that all sites have to be screen reader compatible Is that not the issue that the blind and partially sighted face when following links from here?

No because most amendment's were rejected.
