Taking assessment again after two failures

I just had a question with regards to the train driver assessment process. Most people know that you are only allowed to fail the assessment process once. Fail it twice and you can never become a Train Driver.

However, with regards to these assessments, the Railway Standards (which TOC's follow with regards to assessments) states that:

"More than one reassessment of the same applicant who has failed the process is unacceptable, unless there are mitigating circumstances that have been documented"

I was therefore just wondering how common it is for people to be allowed to sit an assessment a third time (after having already failed 2 previous assessments). Has anyone on here been allowed to do this in the past (in 'mitigating circumstances').

I have heard first hand from somebody who was allowed to do this (ie. he failed the first 2 assessments but was allowed a 3rd attempt which he passed) so I know that it does happen, but was just wondering how often, and under what types of 'mitigating circumstances' it would be allowed.

I haven't failed the assessment process twice myself (failed once, determined to pass it next time !) but was just wondering.

I have only ever known of this once and this was a candidate who when he arrived at the assessment centre told them that he had a berievement and would like to postpone his assessment, the TOC told him to go ahaead and if he failed it would not be taken as one of his 2 attempts however he passed the assessment and is now a train driver but if he had failed he would have been able to retake for a 3rd time.
