Statutory Declarations

With all this talk on this section of making statutory declarations to reset the clock, does anyone know what the penalty is for making a false one?

Maybe it would be worth mentioning on threads where the advice is to make a SD that making a false one is such a serious offence.

Yes, I agree that it would be prudent to always make such a cautionary 'reminder' when suggesting someone makes a Statutory Declaration (SD).

In fact, it is not a route that I tend to advise on here (only once that I recall), because we only have one person's side of the incident presented to us, and when that person claims "nobody told me" or "I didn't get any letters" on an internet forum, after having admitted some other little deceit while travelling, then we have to wonder just how realistic it is to advise them to make a Declaration, under oath, and at risk of perjury, swearing that they really "didn't know anything about it".

Ignorance follows from stupidity or deprivation; it is not a weapon in the forum of legal dispute.

BTW. A SD doesn't necessarily have to be made in the Court Offices as is generally suggested. It can be made in front of a solicitor in their office or elsewhere, but I always find that the advice that the person must go into the Court Office to make the Declaration is likely to deter some of the 'chancers' !

I had been having a difficult time at work; was on medication; felt unwell; and the man on the platform said I should make a Statutory Declaration. I am training to be a lawyer, and need a visa for the USA. Will an out of court settlement be an option?

And you also forgot they they were a "bully" and "made me cry".:D

Funny thing is that I've never yet in all my years of travelling seen anyone brought to tears by revenue officers. Yet, what I have seen rather a lot of people getting mouthy and being very uncooperative and dismissive.

I must travel some very weird routes to experience things so differently.

I learnt when I was a guard, all them delay reports because the drivers are too bloody slow! ;)

True, but when someone is completely and utterly in the wrong, the claim of staff being rude is rather less likely to be true. Not to mention less relevant.

There are far more rude passengers about!

I once (well okay it happens quite often) had somebody ask me the same question 3 times, and I gave them all the information I could including the time and platform the train they wanted to catch would likely go from but they still asked again, I replied "sorry I have to go" and walked off (I was changing ends at the time and it was only 8 minutes, guess what, I got reported for being rude. Go figure.

Being rude is subjective and opinion of an individual and I doubt an allegation of being rude could ever be disciplined successfully if correct legal procedures are followed.
In my industry we get a lot of "rude" complaints but as all conversations are recorded, when listened to by management a very small minority are deemed rude.
If customers don't get what they want they say the employee was rude we see a lot.

As an absolute number? Undoubtedly. That'll be because there are millions of passenger and thousands of customer-facing rail employees As a percentage of the total, I very much doubt it.

Based on my experience of RPIs the ratio of Aggressive:Non-Aggressive sits at about 1:3. There is no way that 1/3 of all passengers are aggressive and unpleasant. The vast majority of them sit quietly, and cause no-one any bother at all. Even on a last train out of Liverpool Street, I bet the number of unpleasant passengers is less than 1 in 10. They're just more noticable.

My last encounter with an RPI on London Midland was good. He was chatty and friendly and he took the mickey out of my Bradford City shirt.

The next bloke he came to he was smiley at first and very quickly became firm and assertive, maybe even authoritarian.

Guess which one of us had a ticket and guess which one of us didn't?

A ratio of 1:3 expressed as a fraction is 1/4, not 1/3

Note that I'm neither agreeing nor disagreeing that it's 1:3 - I've only ever encountered one member of staff who's identified themselves as revenue-protection (when attempting to board a Gatwick Express with a Southern-only ticket)
