Railcard expiry - England/SW Railway

I’m 20 and got stopped a few months ago by the transport police who were checking tickets and they found that my railcard had expired. I got stopped at Weybridge on a trip to Egham. It had been expired for 4 months but I am an infrequent traveller by train (once a month ish) so I hadn’t noticed. Stupid of me but I renewed it on the spot and got an email saying some bloke was going to be investigating it for fraud. I replied, explaining why it happened and apologised profusely, promised it won’t happen again and he’s replied ‘thanks for your correspondence, I have concluded my investigation and recommend no further action on the fraud investigation.’ He then goes onto say ‘your case will now revert to prosecutions… I have no say over this process but my guess is that it will be dealt with as a stand alone matter on the day that you were stopped.’

Can’t quite tell by the language whether I’m in the clear or not? Am happy to pay a fine/out of court settlement but have seen the faff it can become if they decide to take it further so just wondering what your read is of this situation? Cheers.

It would help if you could post the e-mail(s) that you have received in this thread so that the experts know exactly what the situation is. Please obscure your name, address and any other identifying details, such as reference numbers.

Was your ticket physical or an E ticket? It sounds as if they’ve audited your account and there is nothing to investigate further. It’s just whether they come back with an admin charge (£120) plus an anytime single ticket price for that journey.

E ticket. Through Trainline. Hence why I got caught out with the railcard as I hadn’t checked it on Trainline. Yeah, can understand if they come back with that, happy to pay and settle but just don’t want them to take me to court. Not sure how common that is but have heard it can happen!

An unusual mail. Just to confirm post #4.

I would now expect a letter regarding the one incident when you were stopped.

Although they will mention prosecution, they will almost certainly be prepared to settle out of court if your engage with them, and the net result will be that you pay the full fare for the journey plus £100+ admin costs.

However, if 6 months have passed the option to prosecute under the Byelaws has passed, so you might be in luck :)

@Hadders may be able to help with this one
From the pinned post:

I'm sure Hadders will respond if they have time and something to add, there's no need to keep tagging them in threads.

I suspect SWR's Prosecutions Department will offer yo an out of court settlement.

Let us know if they contact you and forum members will assist with next steps.
