I travelled from Sheffield to Chesterfield and had a weekly season ticket, which I had bought the day before.
I was asked by a Revenue Officer for the ticket, which I tried to show on the EMR app.
The internet was slow, plus the EMR app was not very responsive. I tried logging out, then logging back in.
This produced my ticket, but by the time I showed it, a penalty fare notice had already been written out.
I have appealed, explaining this, and am awaiting their decision.
I just wondered how likely it would be for my appeal to be successful, as it's over £100?
Thanks.
I know you can 'load' the ticket beforehand, so it doesn't rely on the internet, which I will be doing from now on.

Forgetting or failing to display a season ticket is valid grounds for an appeal as long as you enclosed proof of the season ticket in your appeal.

How much did you pay for the weekly season ticket?

Firstly, work through the appeals system as you have done.

Secondly, you can write to the train company and try to persuade it to cancel the Penalty Fare.

Thirdly, if they don't and you do have to pay it, ask the retailer where you bought the season ticket for a refund of the Penalty Fare. Normally they will do this up to two times a year, but they are not obliged to and can deduct up to £10.

I regularly travel through Chesterfield from Sheffield and there is a large "black spot" where neither the EMR on train WiFi will connect to the internet and neither will my phone GSM data work ..

The appeal should be upheld under 16(3)(c) but handling of appeals can be a bit random!

16 (3) The grounds on which an appeal under this regulation may be made are that—
...
(c) the appellant owns a season ticket valid for the journey in question but was not in possession of the season ticket at the time the penalty fare was charged;

The weekly ticket was £38.10 and was bought from the EMR app.
You mean write to the train company at the same time as going through the appeal system?
Thanks - the retailer info. is very useful.

Yes, it's not great at all.

Great! This eases my mind a bit. Thanks.

So from the price it was a normal season ticket.

Wait to see if they accept the appeal before doing anything else.
If they don't, you can do a second appeal actually quoting that regulation specifically.
