Section 22 Permits and D1

A bit of a grey area for me but just after some clarification regarding Section 22 permits and who can drive.

I understand that S22 permits are only issued to ‘not for profit’ organisations e.g. CT operators and local authorities.

Scenario 1 - if you have a person with a licence issued before 1997 and they have a D1 (101) can they drive a minibus on a S22 (registered bus service) and be paid for it?

Scenario 2 - if you have a person who passed their car driving test in 2006 (only have Cat B) they can only drive a minibus up to 3.5 tonnes (4.25T with trailer)? Ideally they need to pass their D1 to drive a minibus or else you have to be confident they don’t exceed the minibus weight limit.

As far as I can tell this is purely down to when you passed your driving test i.e. related to your age.

When would you need to have a driver CPC? Is this only applicable if operating on an ‘O’ licence?

I don't know the overall answer, but with regard to weight limits it is the plated gross vehicle weight/maximum allowed mass that counts, not the actual weight (if lower; if higher the vehicle is not legal regardless of who is driving).

Also regarding 3500 vs 4250kg the extra 750kg is for a wheelchair lift and related equipment. A non D/D1 holder can never tow a trailer.

I would say you have got it about right.
In your scenario 1 - yes, drivers can be paid.
In your scenario 2 - yes, if you passed your car test after 1997 you don’t get any minibus entitlement under D1 but your car licence allows you to drive minibuses on a voluntary basis for social purposes by a non- commercial body. The weights you quote are correct but it’s not 4.25 with a trailer, it’s 4.25 if the minibus is accessible, eg wheelchair lift or ramp.
Yes, it is about when you passed your car test - the law changed in 1997 as you say.
No CPC is required but would be if you drove professionally under an operators licence, so for hire or reward.
