ScotRail penalty fare

I was recently given a penalty fare by a ScotRail revenue officer and gave my details however the email I gave I no longer have access to but the address and my name are all correct, and I’m worried about only being sent an email to pay back the penalty instead of receiving a letter in the post does anyone know if a letter is sent or if it’s just an email, thanks

Are you sure you were given a penalty fare? You would have been given a penalty fare notice and I don’t believe it’s standard to take email address when issuing a penalty fare but this could be different being Scotland.

Yeah I’m sure it was a penalty fare or a fine for not having a ticket, I had to give email address date of birth etc but have 21 days to respond or it gets taken further which is why I’m worried if they only communicate through email.

Just to clarify this did happen in Scotland yes? Not sure if Scotrail even run any services into England but just want to double check!

I am pretty sure ScotRail doesn’t have penalty fares, though it has been considered.
ScotRail does have a (rarely used) policy of only selling undiscounted fares on the train if facilities to buy a ticket before boarding were available, but penalty fares on ScotRail would be a new one on me.

Scotrail do not give penalty fares so we need to get to the crux of what has happened here. It is most likely your details were taken for investigation.

Were you given any paperwork on the train? What was the nature of the dispute?

This might be helpful. Sounds like it’s probably a TIR that was issued.

It says:

Which suggests that an email address might be taken to enable them to get in touch later?

Might be worth contacting Scotrail with the time and location of the incident (without providing any potentially incriminating information) and asking them to update the email address as the email provided is no longer accessible?

No I wasn’t given any paperwork or any reference numbers or anything, it was because I had the wrong ticket for the journey the revenue officer took my details and said they’d send something in the coming days/weeks

Yeah I’ve tried contacting they said there’s no direct communication link to the revenue team so it’s been impossible to get the email updated so far

A fine is issued by a court, a revenue protection officer cannot issue a fine. It sounds like your details have been taken so they can investigate and get back to you with next steps - probably asking you to pay the fare owed. But this could escalate if their correspondence doesn’t reach you.

How have you contacted them? If you’ve called it might be best to email so they have time to actually look into it.

Yeah I’ve called and emailed customer relations with no reply yet, was given an email to get in touch with that isn’t valid

There are no private prosecutions in Scotland, so I wonder what "taken further" actually means here - handed off to BTP? Civil action?

Yeah I’ve been trying to find out but can’t see anywhere and they’re impossible to get in touch with so can’t even find out

This would depend on circumstances. AFAIAA, those that have engaged with the process, but ultimately do not pay, will have their "debt" sold on to a collection agency, and it will be that agency that take further action.

Those that do not engage with the process, may also be dealt with by a debt collection agency, OR their details may be handed to the BTP for a potential criminal charge.

So do you think if I can’t reply to their emails that it will go down as not engaging as I’m not sure if that’s the only channel they use for contacting as I don’t use that email and can’t contact them to update

No, I would hope not. In any case keep a copy of those emails until this is resolved - as those are proof you have been engaging.

Did this ever get sorted in the end? Something similar happened to me and (despite giving my correct details) i’ve heard nothing from them and it’s been 2 months. I’m assuming i’m under some sort of investigation, or nobody’s bothered to press further.

Scotrail don't and can't issue penalty fares. The is no legislation in Scotland that allows this. They can complete a TIR which means you'll be sent a bill for a full priced single fare and probably an admin fee.

They take a name, address, email and phone number but you're only obligated to give a name and address. They'll use email as a first point of contact and then post if that's not available.

You're also asked to pay the correct fare on the train before it gets to the point of taking details. Was this done?

On awaiting my train this morning there was an Automated announcement stating from 1st June anyone without a ticket will be charged a single fare of £10. A bargain on longer trips!

It said minimum fare of £10. I'm sure there's another thread on the subject somewhere
