Hi,

Got pulled over by an officer who scanned my ticket from Reading West to Reading and I told the truth about actually travelling from Paddington
I've been reported for prosecution now but I'm worried about previous travel history being checked and what the likelihood for prosecution/a settlement is if previous tickets from Reading West to reading etc can be seen in my account?
Very stressed and know it will be a while till I get a letter so looking for any advice on this really

Welcome to the forum. GWR usually settle out of court and only prosecute as a very last resort. A criminal record is unlikely.

As you’ve been unwisely short faring for some time you should prepare to pay the full fare from London to Reading for each and every occasion you’ve dodged the fare plus an administration fee of £100. The full single fare is

£29.20 just now.

(For each London Paddington -> Reading journey).

I can pay the fares I suppose, just stressed out about it.

are they likely to check the travel history in all cases even if the officer didn't ask me about it?

It's entirely possible, but you aren't obliged to self incriminate yourself when replying to the TOC's revenue protection investigation team.

Usual advice is to post a copy of any letter received in due course, on here, with personal details / ID reference numbers suitably obscured, so that we can then suggest how best to respond.

Presume you've provided a bona-fide name and address, for them to contact you, should the case may be, and you aren't planning on moving address any time soon.

Yes, but you don’t have to tell them about it proactively and isn’t likely to be in your interests.

How did you manage to get through the gates at Paddington?

Most of the time I got on trains that were at platforms without barriers otherwise a couple of times I got a southall to paddington ticket

Will they find the Southall tickets bought on the same account as the Reading West ones?

I’m sure you will realise how that will look to them, especially if they match up at the same times of day.

Welcome to the forum!

We are seeing lots of cases like this at the moment and here's the advice I normally give to people who seek our advice in similar circumstances to yourself.

I expect you will; receive a letter from the train company or an investigation company acting on their behalf. The letter will typically take a couple of months to arrive but can be sooner although it shouldn't take longer than six months. The letter will say that they have received a report, are considering prosecuting you and asking for your version of events before deciding how to proceed. It is important that you engage with and reply to this letter. You might want to include the following in your reply:

- That you are sorry for what has happened
- What you have learned from the incident
- That you are keen to settle the matter without the need for court action
- Offer to pay the outstanding fare and the train company's administrative costs in dealing with the matter

Make sure your reply is short and concise, don't give a sob story - they've heard it all before. Most train companies are usually prepared to offer an administrative settlement (commonly known as an out of court settlement) for people who engage with the process and who haven't come to their attention before. There is no guarantee of this and the train company would be well within their rights to prosecute you in the magistrates court.

An aggravating factor in your case is that you have done this before, and it sounds as though you have been doing what is known as 'donutting', which is purchasing short distance tickets for each end of your journey to get through the barriers but leaving a gap int he middle. The train company will be able to search your online purchase history and you will need to be careful how you reply to the letter. You should answer the questions they ask for truthfully but you are not required to incriminate yourself either.

If you are offered a settlement the amount varies depending on the train company and circumstances but tend to be a few hundred pounds plus the outstanding fare. An out of court settlement might appear to be a fine, but it isn't and you won't have a criminal record as a result of accepting one.

Feel free to post a copy of the letter once it arrives (with personal details redacted) along with your draft reply in this thread and forum members will be happy to proof read it. for you.

whilst you wait to hear from them it would be worth you reading the GWR Revenue Protection Policy - the pdf download - from their website. Will help you know what to expect

Also - be aware they can check all of the on line ticket purchasing websites to check your purchase history so they will see the fares you have been buying to enable the 'doughnutting' that you have been doing.

What was the outcome ? penalty fare ? out of court settlement ? via court settlement ?
I doubt if there is an outcome yet (though it can't be a penalty fare), and may not be for several weeks. I note you have your own thread, so thanks.
