Repay delay claim; help needed!

Greeting!

So I bough an open return

The first trip was A-D

And the return trip was D-A



The first trip was to comprise of 4 changes

1st trip was A-B With train company 1

2nd trip was B-C with train company 2

3rd trip was C-D with train company 3

,4th trip D-E with train company 4

The 1st trip A-B was with train company 1 and was late and caused me to miss the 2nd trip. The next train after that was delayed and cancelled. So when I completed the 2nd trip and arrived at the 3rd, it was to late to catch any more trains for the night so the station staff book me a taxi to my final destination and billed train company 1 for it since it was them that caused the delay. I arrived at my final destination in the taxi well over 2 hours late



The return journey comprised of 3 changes

1st trip E-C with train company 5

2nd Trip C-B with train company 6

3rd trip B-A with train company 7

The 1st trip with train company 5 the toilets where not working but it arrived on time, the second 2nd trip with train company 6 was delayed and as of such I missed my 3rd trip and no more trains for the night. Again the platform staff booked me a taxi to my final destination and I was just over 2 hours late. There where no buses running at that time and I had to get a taxi home


Questions:


For the first journey. How much can I claim from Train company 1?

For the return journey. How much can I claim against train company 6? Can I claim my taxi fair home from them as well? Can I claim against train company 5 for no toilets working?

I don't come on the forum to do algebra so if you could amend your post so you name all the train stations and name the train companies we will be able to help you.

What has station E got to do with this, as you say you had a ticket to station D?

Otherwise, as has often been pointed out in similar requests, you are only going to get answers by setting out your actual itinerary and what actually happened. We don't do algebra.

However, on a couple of points:
Can I claim my taxi fair home from them as well?
The train operator completed it's contract by getting you to your destination - the one on your ticket - so have no obligation for anything further. You can ask them to compensate you for that, but it's a separate matter to the Delay Repay claim.
Can I claim against train company 5 for no toilets working?
You can complain to the train operator if you like, but you are unlikely to get more than an apology.

Please list your actual itinerary with the correct station names, company names, and the scheduled and actual times of the train you took. This is impossible to follow; people have to be able to picture your journey to offer detailed and specific advice.

Right

So I suppose what you’re actually asking is “can I claim 100% delay repay twice for a 2+ hour delay in both directions”?

The answer is no, your maximum delay repay can’t be more than the price you paid.

However, if the company causing the delay is different in each direction, and you chose to try for delay repay from both, you might get away with it

But that’s between you and your conscience and the risk of them figuring it out at a later stage

We still need to see the itinerary to make sure the journey is actually compliant and that there were no alternatives the OP will get a nasty surprise about when they claim. On the claim for the taxi this is most important as they will be relying on their PRO rights.

So, please post the actual itinerary if you want to get the best possible help.

Which stations were you travelling from? (the station names, not A, B, C etc)
What times were the trains you intended to catch? (The exact times, listed in table format is best as it is easier to understand)
What tickets did you use?

is there any legislation that I can read up about? I mean are rail companies legally adviced to give refunds or is it there company polices to do so?

Well yes of course there are Passenger Charters, the National Rail Conditions of Travel and various pieces of consumer legislation but we are trying to check your claim qualifies. All you need to do is give us the information we've repeatedly been asking for and you can get that help, and be told exactly how to claim and from where.

The answer is yes, you can claim. Provided that the information that you submit is true and honest, you are doing nothing wrong in claiming. Whether you will get both claims paid is another matter.

The only potentially dubious situation would be if you raised the second claim after the first had been paid. Because then you would know that you weren't entitled to any further compensation. But even then, the rules still allow for further payments at discretion, so I would still say you would be doing nothing wrong in raising a second claim - it is up to the TOC whether they pay it at their discretion or not.

My advice in such situations would always be to raise both claims. If you only raise one claim, and the TOC decides to deny it, or only part pay it, by that time it may be too late to raise the other claim.

That is not how delay repay works. You tell them how late you arrived at your destination station, they work out how much they are going to pay you. Nowhere in the claim do you say anything like "I claim £xx".

It isn't practical to give meaningful advice based on algebra.

The simple answer to that is yes, but:

- I’m sure you already know that because it’s a straightforward thing to google

- it depends on having a valid itinerary if you’re using more than one train

- different train companies have different rules (eg some offer it from 15 minutes delay, some don’t)

- etc

Which is why people have repeatedly asked you to show the detail of your journeys if you want proper advice

How much you might be entitled to, and how much you claim for, are very different questions. You don't claim an amount of money, you only claim that you were delayed an amount of time.

As previous poster has pointed out, they tell you how much you may be entitled to if your claim is approved. As well as needing a valid itinerary, your claim also needs to meet the TOC's delay repay rules, and rules hidden away in the NRCoT (such as not being entitled to more compensation than the ticket price) that some TOCs don't mention on their claim pages.
