I asked Southern about this, and they said you have to buy a new ticket if your train was effectively cancelled because you were unable to board.

I don't think that would be aloud under the Fair Trading Act.

If a train is cancelled you are covered by the NRCoC and there should be no need to buy another ticket.

To my mind 'being unable to board' does not equate to a cancellation and the question of what happens depends on whether you were prevented from boarding by an authorised person or decided not to board of your own volition.

... in my experience, if the train is so overcrowded that it is physically impossible to board then the guard/driver/platform staff will state that the train will have to leave people behind i.e. the equivalent of being refused admission.

I guess Southern can't officially allow passengers to get the next train as it would lead them open to people claiming that the previous train was full. Probably in practice you would get away with it.

I had somebody tonight claiming the train was overcrowded and he couldn't get a seat, which was a disgrace. He was less than happy when I told him he had a reserved seat - on the next train, and as he was on an Advance ticket, he could get off and occupy it when it arrived in thirty minute...

I had someone sitting in first on a standard the other day. As I threw him out he was going the 'but I have a ticket and there are no seats'. I gave him the 'ticket is valid for a journey, not a seat', but then pointed out there were seats available'. Swearing he went and stood up. As I moved down the train I pointed out empty seats to him, and yet he still stood. I guess an empty seat for him is a group 4 round a table with no other passengers to share.
