I have received letter of prosecution today (3 months after) for not travelling with my railcard on 14th Nov 24 at Haywards Heath. I can not find my railcard and suspect its probably expired. After reading threads on here i am now really scared. My life admin has suffered in last couple of years due to Major facial paralysis and also having major surgery (reason for travel on day of question), will they take this into account? Im guessing they will also look at my past tickets and add that on to the bill? i do not travel on the train more than 1/2 times a month and have never been fined before. This all seems extreme, no option to pay a fine or full ticket price instead but straight to prosecution?? Its cheaper to drive but that's not what we should be all doing-cry
I will reply with full apology and explanation as above but just wanted some advise?

I am writing in response to letter dated 5th Feb 2025 regarding the incident on 14th Nov 2024.
Firstly I want to sincerely apologise for travelling without a railcard, it was certainly not my intention to do so. In the moment with the Ticket Officer I felt very frightened not fully understanding what was said and what may happen next especially as the train was full and so we had an audience.
I would like to explain my circumstances in hope there may be some discretion to not prosecute. Over the last 2 years I have suffered from 2 major health conditions that both presented overnight - Bells Palsy Ramsay Hunt (facial paralysis) and having a hysterectomy (major surgery removing organs) 12 weeks ago which was reason for travel on 14th Nov. Being a single parent and still recovering from both of these health matters my admin life has slowly crumbled, I am really struggling to keep on top of everything. My partner would normally organise the railcard and many other things and we would always travel together however we have separated.
I have now purchased a railcard to ensure this does not happen again.
Please find enclosed evidence of my health conditions
