They would certainly be liable for any delay costs attributed to the loco failure. I'm not sure if there are any "That shouldn't have happened" penalties other than delay costs though.

I'd certainly agree with @Viper the costs of any knock on delays and, of course, Thunderbird attendance, a very rare event in my experience I can only recall two instances which were both 47s and both down to Burkhardt 'inspired' EWS penny pinching
