Prosecution notice for no photocard.

Hi guys, I was travelling to Ashtead from Waterloo on a weekly ticket. I was issued a prosecution notice for not having my accompanying photocard. I thought I'd lost it, but when I got home, I had a proper look and found it pretty quickly, annoyingly. I've replied to the prosecution service providing evidence of the photocard. This is the first time I've ever been handed one and I've been travelling with SWR regularly for the last 5 years. I explained all this in the email. Am I likely to get a fine? Is there a chance they'll let me off? Thanks.

It would help if we could understand exactly what’s happened here. After removing your details and any ref numbers can you up load a copy of any paperwork you were given. I’m not sure what a prosecution notice is / what you mean by this. Seeing the paperwork will help.

Was it a Penalty Fare?

Or was it something that is called something like a Travel Irregularity Report. ?

Also may help if you can post up a copy of the e mail you say you have sent, and where you have sent it.

I’m sure people will be able to advise on what’s likely to happen next and how you can best deal with it.

38. Season Ticket or Photocard Unavailable for Inspection

38.1 If you are unable to present a Season Ticket, or any photocard required with a Season Ticket, when asked by the staff or authorised agents of a Train Company, you will be treated as having joined a train without a valid Ticket and Condition 9 will apply.

38.2 If you possess a valid Season Ticket and/or photocard but were unable to present it when requested because you had forgotten to carry it on that particular journey or mislaid it, the Train Company concerned may at their discretion refund any fare or Penalty Fare paid in accordance with Condition 9, less an administration charge not exceeding £10.

38.3 In order to claim such a refund, you will need to provide the retailer from whom you bought your Season Ticket with your Season Ticket (and photocard if applicable), together with the additional Tickets you have purchased or any Penalty Fares notices.

38.4 A maximum of two such claims will be considered in any 12-month period regardless of the number of Season Tickets bought during that time.

Even though this applies strictly to refunds of a new ticket, supplying the photocard should be sufficient to make the matter go away.

Agreed, we've seen this work where asking to invoke the "Forgotten Railcard" policy has resolved a report for prosecution even though the policy doesn't say that.
