Hi all,

Hope everyone is well! I was just wondering if there have been any cases on this forum or that people know of in which someone was actually convicted of fare evasion/short-faring/doughnutting in court? Or any cases in which the TOC refused an out of court settlement?

Or is it likely that more often than not TOC choose to proceed with an out of court settlement after the initial correspondence and an apology reply with good engagement through the process?

A quick read through the current threads will easily reveal the answers you're looking for. (yes and yes!)

If you have a specific situation, please post the details for some constructive, tailored, advice.

Often such situations seem to arise because the persons either fail to engage with the train company; have given out a false name and/or address, or (if they have given a correct name / address) subsequently move elsewhere and don't bother to arrange for any mail re-direction.

Was also wondering (Slightly off topic but) if TOC share data or passenger information amongst themselves? For example, can EMR check passenger ticket purchases from GA?

This case from 2015 is perhaps the highest profile court case, as it involved a barrister...

"Barrister Dr Peter Barnett has received a 16-week prison sentence, suspended for 12 months, 200 hours of community service, and a compensation order of nearly £6,000 for evading rail fares on his commute from Haddenham and Thame Parkway to London Marylebone. It was alleged that this was achieved by Dr Barnett tapping his oyster card in and out at Wembley to avoid paying the charge for his whole journey. The evasion was said to have occurred on 655 days between April 2012 and November 2014 - the equivalent of £19,689 in unpaid fares. Dr Barnett pleaded guilty to the offence of fraud by misrepresentation contrary to section 2 of the Fraud Act 2006."

Trainline seems to quite often share data, relatively freely, ostensibly this should always be in connection with the "detection of fraud".

If you have a specific situation, please post the details for some constructive, tailored, advice.
That would seem to be good advice. Fairly unusual couple of opening posts from a New Member otherwise.

Yes they can. Especially if you were caught using a ticket purchased from that retailer.

If you have an actual issue you need advice with, please post what it is, in full, as drip-feeding the extent of your problem is not going to result in the best advice.
