And if/when they are in touch … would this be with the bog standard fine to begin with?
If by "bog standard fine" you mean Penalty Fare of £50/100 plus the fare due - no. A Penalty Fare cannot be retrospectively issued.

If you've not come to their attention before they are likely to offer a settlement of £100ish plus the fare due though.

You'll need to come back on here for advice as sugggested - but possibly not the bog standard Penalty Fare no (but they MIGHT ask for a similar sum eg £100 ish, but no £50 prompt payment discount), this is why refusing the Penalty Fare almost always ends up costing more if things dealt with after the event - but head back here if you hear from them.

As others have said your ticket was only valid for the specific train you booked.

Unfortunately refusing to give details when asked is a criminal offence. If your ticket was purchased online and the details of it were taken by the inspector (either manually of via a scan) then Northern will be able to link it back to you via your online ticket purchasing account.

This is where there has been a massive miscommunication…this was never explained to me in the moment, despite me asking multiple questions about why this was the case and what my options were. She asked if I was willing to provide more details and I said no because I still don’t understand the issue… and like I said she walked off … I just don’t understand why this information isn’t more accessible for people or can be shared there and then, just as it would be with any other fine

It seems unlikely that the inspector told you nothing at all about why your Advance ticket was invalid. If you refuse to pay the Penalty Fare and claim ignorance, and also fail to provide your details, you commit an offence anyway; you are legally required to give your name and address to an authorised person on the railway. It seems most likley the staff member thought, rightly or wrongly, that you were being difficult, and hence has submitted your ticket details to the revenue protection team to follow up.

However, it is not guaranteed that you will receive correspondence from them. Perhaps she didn't report you at all. Who knows?

I don't use Trainline but I assume when you booked/purchased the ticket, there would have been an alert or warning that your ticket can only be used on the specified train.

Unfortunately, not reading the terms and conditions of purchase is not a defence....

It's your responsibility to make sure you have the correct ticket before boarding a train. Although some apps and webaites could be clearer when displaying restrictions the information would've been visible at the time you purchased your ticket.

That said, you are where you are now and you can't turn the clock back so the thing to think about is how to get a satisfactory outcome when Northern write to you.

I don’t believe I could have been seen as being ‘difficult’ in any way, shape or form. Nothing ‘difficult’ about politely asking a few questions to gain some understanding.

What I still don’t understand is why she couldn’t have said ‘if you don’t provide your details now … x,y&z will be the outcome’. At what point was I supposed to know that her asking if I am willing to provide details and me saying not really because I don’t know what I’m giving them for is a criminal offence…THESE are the things I am referring to not being shared correctly or at all for that matter

Attached are the views given when purchasing a ticket on trainline, not a pop up or warning as such but a brief description under advance single of what the ticket allows.
(Random ticket Doncaster-Leeds for tomorrow 1026 chosen to use as example of Trainline format)

The OP would have needed to select the yellow circled option to choose an anytime or off peak ticket for their journey, access by pressing the small grey arrow.

Failing to give your details when asked is being difficult.

I was asked if I was willing to give them and I simply said I didn’t understand why I was being asked that … clearly we have very different views on being difficult.

Like I’ve previously said… I am here for help and advice, if you have none of the above then I would prefer you to not waste my time

Unfortunately for you the Railway Byelaws which you broke by not providing your details don't say that you are entitled to an explanation. Had the police been called you could have been arrested.

Sadly your education on ticketing matters is likely to come at a hefty price.

Guess that's the end of that then.... sorry you don't like, or agree with the advice given to you

Not engaging with an officer of the railway company is good

Good luck on when you receive a letter or summons to court (if the train company escalate this further)

Arrested?!! For buying a wrong ticket … what has the world come to?!

Maybe there should be more out there to educate people about these issues

Failure to present a ticket could result in fines up to £100 or prosecution.

Buying a ticket before you travel is easy and can be done online, via our app, or at the station ticket vending machines and ticket office.

Ticketless travel costs the UK rail industry £200 million per year, that’s money which could go towards improving standards and services. Travelling without a valid ticket is a criminal offence and if caught offenders face a penalty fare of £100 and a potential criminal record.

2019 saw 49,884 penalty fare notices issued across the Northern network, with 4,904 passengers convicted in the Magistrates Court.

Whether it's deemed fair when you had paid for an actual ticket (albeit on another service) is a discussion for another thread.

Railway staff cannot request name and address without good cause. Furthermore, I believe they are to state the nature of the offence given at the time of asking for your name and address.

Did she expressly ask for you name and address (not "details" but actually say name and address) and state the reason why and your requirement to provide such information?

Thank you for your insight.

She just asked would I be willing to ‘provide further details’ there was no specific mention of name and address

You wouldn't have been arrested over the wrong ticket. You would have been arrested for failure to supply your details. You may want to look at Byelaw 23.

Byelaw 23.2 states that the nature of the offence has to be given in general terms. A statement that that the ticket held by the passenger is invalid would seem to meet that requirement.

Like I said, I was unaware of any of this at the time and can’t seem to understand why this wouldn’t have been explained if this is as serious as I am being told

Hard to know obviously, but to have a guess I suspect she just gets fed up with dealing with the numerous people who for one reason or another (many deliberate, but I don't mean you) who just refuse to answer questions / dodge fares deliberately etc etc, and has better things to do with other tickets to check and duties on the train. If she thinks she has the info needed from the ticket scan data that will just go to the back office and she can let the staff there deal with it. Or she may have just thought 'I'll just forget this one' and may do nothing further and you may not hear any more about this.

I was on the train last week and sitting opposite me was (it seemed to me at least) a fare dodger, claimed could not show a ticket as phone broken, claimed had no money on him to buy a new ticket, claimed no ID to show - wasn't aggressive to the staff but the guard just had to move on and check other tickets as the guy was deliberately not co-operating. Staff must get this all the time. For some people telling them that if they do not give name and address the police will be called can escalate situations and result in assaults etc. Not saying that you would be like any of that but you'll appreciate that the staff who spoke to you might be mindful of what can happen.

Every time you buy a ticket from Trainline (or any other AND BETTER retailer) there is an explanation of the tickets you have bought, even if that means you have to look at a new screen, normally if you click on a little question mark or info icon. That is just like the Terms and Conditions you agree to but probably never bother to read when you buy something on most on-line purchases. Can I bet you never read those T & C's?

Have you any idea of the timescale you’re likely to hear from them in? I’ve been previously told 6 months but that just seems a long time deliberating and wondering

Sometimes I do, sometimes I don't, but what I do ensure is that when I buy something like a rail ticket I do make sure I know exactly what I have bought and when it is valid, since I am not an expert in ticketing matters.

The problem to my mind is they sell these Advance tickets with heavy discounts but in exchange for that you loose all flexibility - I never buy them unless I get a decent discount off the normal fare as I do not want to sacrifice flexibility unless I'm getting enough money off to make that worthwhile. But this is often not made abundantly clear when buying your ticket - where the headline cheapest price is designed to make that ticket choice look attractive, when it has downsides of being worthless on any other train service apart from the one specified on the ticket.

I don't blame you for not knowing that of course.

Mistakes happen unfortunately, they’re learning curves.

Absolutely agree. Like I said, having done this on occasion before and not having a problem with it I never realised the issue. At least now I do!

Thank you for your help.

Do you have any idea whether it take up to 6 months to find out the outcome or am I likely to hear earlier?

Hard to be sure - cases on here people usually hear between a few weeks or a couple of months - but the reason people say up to 6 months is because they can't prosecute the offence of fare evasion after 6 months from the date IIRC - but you do need to thus keep an eye on hard copy post during this period at the address that would be linked to your bank account payment method I guess. Keep an eye out for e-mails and check spam folders too to be sure.

Chances are if you are going to hear it will be sooner than the 6 months tho.

But like I say, it may be that nothing will happen as the guard might take the view that what you did wrong is not the biggest thing and she just walks off and lets it go. Hard to know for sure of course.
